Partial refund due to item not matching description

I bought items (curriculum ). Item condition was listed as 'Very Good'. I even contacted the seller asking to make sure nothing was missing, she assured me nothing was. However, upon receiving the items, there were several pages missing that were not disclosed. The seller then became uncooperative and lied. Their listing says they do not accept returns. I asked for a partial refund of $36  (total sales cost being $95.97) and they will not agree to it. She offered me $5 which is unsatisfactory and now I have to buy new ones from the curriculum company at full price which would come to $36 for the three books that were missing pages. What can I do to to help resolve this situation?

I have heard of those situations, many times. So it seems that just because you haven't heard of it doesn't mean it doesn't happen.

I think it may depend on the return policy in the listing.  ‘No returns accepted’ seems to cause eBay to refund in full automatically … even with expensive items.

 

[Within the last week, I read a thread where eBay provided a return label when asked to step in … and I recall being surprised.  Unfortunately, I didn’t check the listing’s return policy and can’t recall anything else about the thread at the moment.]   

ETA:  We are much more likely to hear from sellers who are irate about eBay’s issuing a full refund than from those where eBay sent a label … so may well have a skewed idea as to how often it happens.

Thank you everyone for your input. Although, I have to say I'm a bit more confused with the back and forth of "yes or no it will/won't work" with some of the replies... trying to make the best choice from all of the information received.

I can understand your confusion.  The bottom line is that while eBay is fine with whatever partial refund the buyer and seller agree to ... eBay will NOT force either the buyer or seller to accept a partial refund only one is happy with.

 

It appears your only recourse with eBay is to accept the seller's partial refund ... OR to return (at seller's expense) the total items you received for a full refund.
