Partial refund due to item not matching description

I bought items (curriculum ). Item condition was listed as 'Very Good'. I even contacted the seller asking to make sure nothing was missing, she assured me nothing was. However, upon receiving the items, there were several pages missing that were not disclosed. The seller then became uncooperative and lied. Their listing says they do not accept returns. I asked for a partial refund of $36  (total sales cost being $95.97) and they will not agree to it. She offered me $5 which is unsatisfactory and now I have to buy new ones from the curriculum company at full price which would come to $36 for the three books that were missing pages. What can I do to to help resolve this situation?

EBay's Money Back Guarantee trumps the seller's no returns policy. Go to the item in your purchase history and click the Return button. Select that the item was not as described to open a case. Three days later you can go back to the case and ask eBay to step in. They'll send you a return shipping label and refund you fully after the seller receives the return.

Thank you for your help and helping me understand this situation. Even though I'd be keeping the remaining books? If I hit the return button and start that process, won't that hinder my requesting of the partial refund because of not returning the remainder of the books. I should have also clarified that the seller did offer me to return all of them. She missed the point that she failed to mention the missing pages at all and I need the books i purchased from her but also have to purchase new from the actual company to complete the set now. She low balled me with a $5 refund only but because of her lack of attention to details and not disclosing correct information entirely.

If you start an eBay 'not as described' return case you will be able to ask for a partial refund through the case. But it's very important to note that, while the seller can agree to a partial refund through the case, eBay can't force a partial refund. The only thing they can enforce is sending you a return shipping label to return everything you received for a full refund. You would be starting from square one.

Return everything you received and get your full refund. You can not just return part pf what you received.

Not completely true. (Correction at bottom)

 

Open the case. Seller has 3 days to respond. Seller can message you, partially refund you, fully refund you or accept return (send you return label). If seller "messages" or partially refunds, you can choose your are satisfied and close the case or choose you are not satisfied and continue. If they send you the $5 they offered, and you're not satisfied, its not over.

 

Seller can refund you in full (w/o return) or send return label. If they fully refund, you keep item. If they accept return and send label, you ship it back. Within a few days of receiving return, seller will refund you. If after a few days of receipt by seller, if seller doesnt refund, you can ask ebay to refund you and they will.

 

If seller does NOTHING in those 3 days, or DOES NOT SATISFY YOU, you can ask ebay to step in. Ebay will NOT send you a return label. They will simply refund you. You get your money & the item. That's why sellers are always encouraged to respond to the case and not let the 3 days pass.

hmmm...I see. I guess then...since I wasn't returning any books because I need the ones that are usable and  there are 3 of them that are unusable, I am out the money altogether and there really isn't any options to hold her accountable. Seller wins... and she gets to keep all of the proceeds (unless I take the low offer of $5 offer) even though she is in the wrong. Just doesn't seem right to me.  😞

File the return. You're not required to complete the return. If you file the return, seller may be more apt to increase the "partial refund".

If seller accepts and sends label, you don't have to ship back. You wont be refunded. But you can at least try to press the seller for a higher partial refund. Returns cost the seller money... if the return shipping is MORE than $5, seller will likely rather pay partial refund than pay for a shipping label.

 

If a return label cost me $20, i rather give a buyer $20 off to keep rather than pay $20 for return

Sorry just frustrated, not at you @kathiec, but the situation. 😞

 

I don't understand how to resolve something that the seller and I do not agree on other than to just give up.... I just wanted some of my money back so I could replace the ones that I can't use. 

 

Key note: Seller told me to just copy from the teachers books, which I can't because of Copyrights. I contacted the company and confirmed this with proof to show this information; seller told me that I could and confirmed with the company . It clearly states at the bottom of all of their books' pages saying 'reproduction is prohibited.'

What you're missing @briana2480 is an actual path forward, actually the only path available on eBay. 

 

First, completely stop talking to the seller.

 

- Click RETURN THIS ITEM to start a return request.

- Select the MISSING PARTS OR PIECES reason -- you are returning parts of the order that's missing pieces.

- Add a comment about the $36, upload a photo, then click Request a return.

Now the seller has the option to offer that $36 partial refund, like this:

So go down this path, then if the seller doesn't offer the $36 partial refund, you can ask eBay to step in.

Sorry, never heard of a single situation where EBay, upon being asked to step in, produces the label and still expects return. It's talked about up and down this forum that sellers need to respond within 3 days to an open claim or else they will lose the money & the item as EBay will refund buyer and not require a return. So your version is news to me, I've never heard of it (only heard of the opposite so many times) or experienced it myself.

If it's factually inaccurate then I agree it's misleading, but it sounds like there are added connotations in your point. "To let someone think this is a route to getting a refund without returning the entire purchase." 

 

It's not a route any buyer can ever choose, as it's not in the buyers control whether they will have the opportunity for EBay to step in (seller doesnt respond to case) and I never suggested anyone return only part of a purchase. I simply suggested what I believed to be true, that EBay stepping in never requires a return of product, only issues a refund, which you've obviously refuted.
