Never got item and Ebay won't help get a refund

Several months ago I "won" an item that was a fraudulent listing.  A picture of a standee put in the standee category. I put in complaints then, as they had about 50 other similar listings, trying to scam people.

Well on these won items, they put the ship date months later of course, to push me to the window of opening return cases. Spoilers, they never even sent the pictures they sold. and so I put in a request for a refund and now ebay says there's "no return option" and I had no recourse then to "message the seller".

How in the heck can I not get a refund from a seller who never sent me an item? How is this scam allowed?

Several months? ebay will help up to 30 days

When was the estimated delivery date?

You only have 30 days past that date to file an INR on Ebay.

If you paid with Pay Pal, they give you 180 days days to file a claim.

You can also file a claim with your credit card.

eBay's Money Back Guarantee offers a very simple way for any buyer to handle the situation if/when a transaction goes wrong.

If the item is not received within a few days past the last estimated delivery date, the buyer can open an item not received case and has 30 days to do that with eBay.  

Coupla questions:  Why would eBay tell you there is no return option? Did you open an item not as described case? 

Yes, you actually had recourse as above.  And did you not see the estimated delivery date prior to bidding or buying? 

Doesn't sound like a scam from what you've posted, just sounds like a buyer who failed to know his options.

The original estimate was in April, but I got a ship notice March 30th, but it was just a label created, and I gave it a full month to arrive from that but never got it.

I did open a case and they told me I wasn't eligible due to the no money back option.

It clearly WAS a scam and I was even told it was here when it happened- ass it was a "picture" pf a standee sold into the standee category and yes at that time I both contacted the seller and opened a not as described case and heard nothing back from ebay.

and with all due respect, one might argue they found a loop hole to scam people, even though they didn't follow the rules, but to argue flooding a category with listings for pictures of rare collectibles, into the collectible category in question is not a scam, means we greatly differ on what a scam is, and is not.

Merriam has the definition as "a dishonest scheme".

Again, you had 30 days after the last estimated delivery date to open an item not received case with eBay.

If that deadline had expired, you have 180 days to open a case with Paypal if that's how you paid.

Last resort, do a chargeback with your credit card.

Again, if you opened an "item not as described" case, it was the wrong kind of case to open.  You would have been told to return the NAD item and what were you planning on returning?
