Item not inside package

Greetings everyone. I seem to have a bit of a dilemma.

I recently purchased an almost impossible to find collector's DVD set that is out of print. It cost me around $450. I was really looking forward to finally owning it.

When I received the package in the mail, the package did not contain the DVD but a few pieces of folded cardboard and air cushions. I inspected the box and there was no damage, but on one side of the box opening the tape was adhered loosely. I could easily peel it away and then re-apply it. I am not sure if this means someone opened it and took the DVD out, but it seems possible.

The DVD was sent First-Class with no insurance. I went to the post office and the worker there said since it was not insured there was nothing they could do. He even said the packaging was inadequate, the way it was taped and it was a re-used box.

The seller appears to be new, they only have 34 feedback from buying and this seems to be the first item they ever sold (no feedback from selling and it was the only thing they had listed in the last 90 days.).

So, I am not sure what to do. I am afraid that the seller and eBay are going to think I am lying. This is the first time I have ever had anything like this happen to me.

DITTO go to your purchase history and find the item and hit thar blue button that says Return this item.

You registered YESTERDAY, bought an item and it was already delivered?

Many people made a posting ID, and I believe this guy did because he doesn't want to be blocked from bidding because sellers might think he's lying about the box being empty.

Yes, I made a new ID for posting here for privacy reasons.

So, I start a refund? Item not as described? The seller has to refund the payment? I feel upset about that because the seller loses the item and money then. But I do not want to lose my money either.

Yes, the seller should have packaged it better.  Not your fault. Insurance is for the seller if they purchased it. Your insurance is MBG. Keep the package and whatever is left inside because you may be required to return the empty package for a refund.  After you request the return the buyer will have 3 days to issue a return label or a refund. If they don't  then go back to the return and ask eBay for the refund.  Don't worry, you're covered.

Yes, you need to open an item not as described case.

You feel upset because the seller loses the item and the money?

If you do not open a case, guess who loses the item and the money?

Have you read the Money Back Guarantee?

Why does it matter if the seller or eBay thinks you are lying? The seller has to refund when he receives back that empty package if he wants it back.

OK, I will open a return case. Thank you all for the help.

I was worried because I have been buying online since the '90s and using eBay since the early 2000s, and this is the first time I have ever had received an empty package. While I was looking at similar occurrences around here, all I see is posts from sellers accusing buyers of lying and threatening them with contacting the police or taking them to court.

I know the seller is partially at fault for not taping the box securely, but I just thought it was unfair for them to lose out as well. But I suppose that is the way it goes.

There's a good chance there was never anything in the package, but what you received.

You described your seller as someone whose account may be hacked and used to sell fake items. In your place i would look around for these pictures online and see if they are taken from eBay or somewhere else. 

If it is just a stock photo and this is the 1st item they sold - likely that box was emtpy to begin with.

 

Sellers that are fair are not afraid to go and take legal action/report fraud with post office while sellers who don't really sell anything, but air are likely not going to do anything but fake such a report on their computer.
