I bought 2 identical items from the same buyer on the same auction. I Received one correct item and the 2nd item was the wrong size. I sent them a message 3 days ago telling them, no response. I tried to open a case "item not as described" and it seems the ebay system will only let me "return it." I want to keep the 1 item. What happened to ebay notifying the seller and me waiting a few days, then if no response ebay deciding what happens? Is this no longer an option? Where do I click exactly to make this happen where ebay steps in?

You need to go through the Ebay Return Request process and return both items since they were both part of one listing/purchase.

so , only option is to return it? Why should I have to drive to the post office and package it up again because the seller made an error? Appreciate your details response, thx. I"m not happy with Ebay procedures, but you were nice and helpful! Thanks

Even though seller is at fault if you expect a refund you have to return the entire order back to the seller

Interesting! If you file a return request using the appropriate NAD return the seller is required to pay the return shipping. You should be able to schedule a pick up or hand it to your carrier if you don't want to drive to the PO. However, if you think you should be refunded without returning the merchandise you're probably out of luck.
Oh! Be sure not to use the "Did Not Fit" reason for the return. I'm afraid that the eBay bots will deem that a remorse return and, at the very least, you will probably have to pay the return shipping yourself.

When you bought 2 identical items from the same buyer and 1 is wrong, eBay allows you to get a refund from the buyer for the wrong item because the buyer made an an error.
But you're correct, why should you have to return the wrong item to get a refund? Just today I called Walmart because a wheel came off of the outdoor gas grill. They found the credit card I used to pay, and just refunded me over the phone, no need to drive to the store.
