I entered the order cancellation request within the hour of mistakenly placing it. It was denied, claiming the item had already shipped. It had not been shipped. This is an eBay problem, not a Seller problem. I don't know how the system works, but I do know that my payment form was immediately debited; that, while a tracking number was then received, the item was not, in fact shipped, and doubtful that even a shipping label had been created.
Is it not fraudulent to state that an item has been shipped? Isn't it still true that in any contract, there is a 24 hour cancellation window? I'm not going after fraud, here, but do want the order cancelled and my payment credited. ?

Fraud cannot occur without a perpetrator … so if fraud has occurred, either you, the seller, or eBay ‘done it’. Maybe you need to reconsider your choice of words.
And, I see now, we've already had one discussion with OP bout this issue:

jasmen@ebay - within the first hour - does the seller have to accept the cancellation in the first hour also(along with the buyer requesting within the first hour)? Or would that be a 'depending on the situation' deal if the seller accepts it 3 hours later?
Translating eBayspeak "The fee credit is automatic within the first hour" likely means that the seller must react to accept the cancellation for "The fee credit is automatic within the first hour" to happen?

@d-k_treasures It should work as long as it's accepted, if for some reason it doesn't then please reach out to CS to have it get looked into!

And the OP even solved that thread him/herself, to boot!

Every buyer as far as I know in the US have 36 hour cancellation. PERIOD. If you don't want it, they should honor your cancellation. This IS for sure Fraud.

YES they sure can. There is a law to protect buyers in the US. Ebay likes to protect foreign sellers for some ungodly reason.

Then Ebay knows how to lie to its BUYERS. Guess they don't want buyers using up precious time. It is the law--cancellations within 3 days is the LAW. Ebay doesn't seem to GAS.

Cooling Off Periods and Consumer Rights to Cancel Contract justia.com consumer-protection-law › ca...
Oct 18, 2022 — Consumers have a three-day cooling off period to cancel certain sales for a full refund.
Notice it says "certain sales"
The term door-to-door sale does not include a transaction:
Conducted and consummated entirely by mail or telephone; and without any other contact between the buyer and the seller or its representative prior to delivery of the goods or performance of the services; or
other than the place of business of the seller
Place of Business - The main or permanent branch office or local address of a seller.

The definitions and rules show this does not apply to eBay.

That does NOT apply to on line sales.
