Hi everyone, I'd really love some help!!
I bought a $600 pair of Rick Owens shoes for my girlfriend's birthday. They arrived and are way too light and look like cheap plastic-y leather. So, I took them to the Rick Owens store in Miami and the sales people agreed they're not real. Therefore, I asked the seller for a refund, I told him the store confirmed they're fake, and I sent him pictures of some flaws.
The seller replied that they're authentic and immediately asked eBay to get involved. Ten minutes later, I was notified that eBay sided with the seller so I would not receive a refund. I have no idea why but I guess it's because the seller has fairly strong feedback (122 stars, 97%). I am extremely frustrated because I wasn't even given a chance to present my entire case - I have more pictures that prove the shoes are fake, and they're actually unwearable because there are three little sharp spikes sticking up through the inside sole by the back heel.
And, for what it's worth, I posted pictures of the shoes on Reddit (there is a "legit check" thread exclusively for Rick Owens) and the moderator and many people have also confirmed the shoes are fake and have pointed out numerous flaws.
Not surprisingly, the seller last month also received negative feedback and review of "horrible seller!" for a different pair of Rick Owens shoes.
Therefore, yesterday morning I called eBay Customer Service to explain my situation and the agent agreed that all my supporting facts should be considered before a decision is reached. He said eBay would contact me yesterday to review this case. However, I still haven't received a call/email from eBay and their customer service phone number won't connect me with an agent.
Can anyone kindly help me? I have attached some photos of the shoes highlighting some serious flaws and the pins in the heel.

do not bother with the pics;
Go to the bottom of this page click on resolution center and file item not as described.
You will have to ship item back for refund if they send you a label.
If to late go to paypal and do it. Credit card is you last option.

Did you go to the Resolution Center and open an item not as described case?
Have no idea why any CS rep would side with the seller on this one.
When a buyer opens an item not as described case with eBay, he never has to prove his case.
Who, exactly, notified you that eBay sided with the seller and exactly what did that message say?
Can you post a screen shot.
Incidentally, 97% is not a great rating for a seller.

You have to actually open a case. Did you do so?
Nothing the seller says matters, and there is no need to call Ebay for anything and never a need to go back and forth with a seller. Open the case for item not as described/fake/counterfeit. https://resolutioncenter.ebay.com/ The seller will be required to send a prepaid shipping label. When they receive the shoes back you will get a full refund.
BTW, seller feedback of 97% is lousy on Ebay.

On Nov 3, I requested a return and told the seller the shoes were fake for a number of reasons. eBay messaged me saying I would have until Nov 7 to come to a resolution with the seller otherwise eBay would make a decision.
On Nov 4, I received a message saying eBay Customer Support has made a final decision and I wouldn't be receiving a refund (although I was previously told I'd have until Nov 7 to present my argument). I have included an image of the decision from eBay.
The only other reason I can think why the seller was found innocent is because many many years ago (probably 7 years or so) my son listed a pair of sneakers for sale and was going to accept payment outside of eBay. However, I'd be shocked if the seller was found innocent because of that...

13 minutes later, I received a message that eBay sided with the seller and I wouldn't receive a refund.
I see that I am able to appeal the case. Should I do that next?

What kind of case did you open?/
Item not received, or item not as described??
If the first all the seller had to do was put in the tracking number and you lose.
The second you should have go a return label from eBay so you could return the item.
If you did not print and ship the items back, you may also have lost the case..
you open the wrong case, or did not follow instructions.
That said, try PayPal as item not as described.

What reason did you use to open the case? And why would you buy these shoes from this seller when he had a negative feedback last month for selling fakes?

Please click on case details ,
remove any mention of the sellers name, and let us see that page.
Some thing is not right here.

Hi and thank you.
I initiated a return on Nov 3 and selected the option "Doesn't seem authentic" and I provided the seller details why the shoes were fake.
Before I purchased the shoes, I unfortunately did not know the seller had received horrible feedback last month for the same brand. Otherwise I would not have bought these 😞

At the top of the page it says to return item.
Should have click on that.
Please go to the resolution center at the bottom of this page, and see if you have any open cases??

This is very puzzling...I wouldnt think an appeal would help you at all...You can file a not as described case at Paypal, but you will be responsible for return shipping.Your last option would be a chargeback on your cc, if thats what you used.

Two mistakes. You should have simply used INAD and left it at that. Doesn't seem authentic is your opinion and is subject to interpretation. For INAD there is no explanation, justification or anything else required. Second mistake was getting into a discussion with the seller when you don't have to. I am quite sure they already know the shoes are fake.

Thanks again Don. Yes, I'm so confused.
The only other thing I can think of is that the seller kept telling me that the shoes were verified authentic by a different clothing marketplace called Grailed.com. I'm not sure why eBay would believe that though.
