Hi everyone, I’m having trouble with getting a refund.
I won an auction on the 5th Oct 2021, and paid for the item on the 9th Oct 2021. However, after 2 weeks waiting without receiving a tracking number. I opened a return case, and accidentally closed it. I contacted the seller and the seller said he/she never had paypal set up and said the item had been sold privately because there are too many scammers on ebay, and never said anything about giving me back the money. The seller stopped responding after that. After the estimated delivery time has passed, I tried to claim the refund, but I couldn’t because eBay said I already filed a case for this item, so I can’t open a new case. Is there any chance I can get my money back?.

File a claim with PayPal or your credit card company, however you paid.

No, it's within your rights to file a dispute. It's your money. You won't get banned unless of course you are abusing refunds. Even then, it would take quite a bit as buyers are treated much better than sellers...but that is a story for another time.

File an "Item not received" dispute here. Go back immediately to click "Escalate to PayPal" at the bottom of the dispute. Then wait up to 11 days (do not respond if the seller contacts you now) for your automatic refund.
Otherwise @sjjqr-67 contact your card issuer to file a "Goods not received" chargeback, to get your refund.

You opened the WRONG kind of case. If you hadn't received your item, what did you plan to return?
The correct case to open would have been an ITEM NOT RECEIVED CASE.
If you paid with Paypal, you should be able to open an INR case there.
Or do a charge back on your credit card.
PLEASE take the time to read eBay's Money Back Guarantee for buyers. It's seen in every listing and it's there to help you if/when a transaction goes wrong.
