I bought a $1,000 item. I contacted the seller to get some info and didn't hear back. I opened a "return item" claim and the seller quickly denied it as he doesn't accept returns. I haven't received the item, any correspondence from the seller or a refund from eBay. I have talked with eBay a couple of times. Last Friday, I was told to keep my line open for a call back that day. It's now Tuesday, no call back. I called again, this time, the rep said my item isn't covered for money back guarantee. I got upset and he mumbled something and put me on hold (I'm guessing to talk to the next "level" person). I've been on hold for over an hour. I'm guessing the "glitch" in this is that I opened a "return item" claim before receiving the item. This is taking up a LOT of my time and I can't afford to be out a thousand dollars!

First, why were you contacting the seller AFTER and not BEFORE the sale? Second, why in the world would you open a return when you hadn't even received the item? What did you think would happen?
It's taking up a lot of your time because, unfortunately, you didn't do things right. I know a buyer can close an item not received and then open a return but have no idea if you can do the reverse. If you paid via PayPal, try them.

First, I can understand how jedisinclair13 might have chosen the process s/he did. EBay's "Contact" process is IMPOSSIBLE! I've been trying to lodge a complaint against a seller and all I end up doing is going in circles with menus. There are lots of options that PROTECT THE SELLER, but I haven't found any that protect the buyer. There doesn't appear to be any way to lodge a complaint against a seller unless you know the seller's NAME, which I don't. None of the paperwork the seller sent me contains his seller name or the name under which he does business. He only signed his paperwork "Duane". So I definitely can understand jedisinclair13 perhaps taking a stab at ANY option to try to get through to SOMEONE at eBay.
Second, have you ever made a mistake in the way you have done something? No? Well, then let us know your real name so we can worship our new god!

I hate to disagree but that’s just wrong. There are MANY more policies in place to protect buyers than there are protections for sellers.
I don’t know what you mean by lodging a complaint. If you bought something and didn’t receive it by the estimated delivery date, you go to the resolution center and open a claim for item not received.
If you bought something and it was not as described in the listing or defective, then you go to the resolution center and and open a return request using not as described or defective as the reason. Ask eBay to step in after 3 days, get a label, send it back, get your refund.
You have 30 days to do either. After that, you can file with PayPal up to 180 days but you would have to pay return shipping if it’s a return.
You don’t need the seller’s name. His ID will be on the item in your purchase history, on the email you got after the sale and on the payment receipt you also got. If you paid with PayPal, it will also be there on your payment transaction.

You said you haven't found a lot of options that protect the buyer? Have you read the MBG? Or PayPal's buyer protection? It's the other way around: there is a LOT of buyer protection and little for sellers.
Yes, I've made a few mistakes. But I take RESPONSIBILITY for my mistakes and don't blame someone else for them. It's really quite easy to contact a seller from whom you've purchased; go to your Purchase History page and click on "Contact seller" on the right hand side of the item.

First, it didn't sound to me like jedisinclair13 was trying to blame anyone for taking the wrong process steps. It sounded more like frustration at eBay's promised phone calls that never came and having to wait so long on hold. Did you also consider that it might have been jedisinclair13's first time using eBay and wasn't aware of the "proper" sequence of steps? Not all users are as online-shopping savvy as you seem to be.
As for my issue, I tried contacting the seller through Automater, which was the recommended way on the downloaded "paperwork" and SUPPOSED "brand new" software with guaranteed "New License KEY", but it has been over a week and "Duane" has not gotten back to me (response time was listed as "usually within 24 hr"). And, unfortunately for me, the seller ID from which I purchased the software is no longer listed so I can't just click on "Contact seller".
I just consider myself ROYALLY SCAMMED!!! Fortunately, for me it was not a lot of money lost. Had it been $1,000, as with jedisinclair13, I'd be angry, too.
I've bought through eBay in the past with no problems. This will just be a lesson, from now on I will be VERY cautious of what I buy and from whom. I should have held to the saying: TRUST NO ONE!

Uh, guess you didn't notice his feedback number; he's not new and has been a member since 2004. Nor did I accuse him of shirking his responsibility. That was in answer to your question asking me if I ever made a mistake (and a couple of other things I won't mention here).
Did you check the "Hidden" button on your Purchase History? Unless the seller/item has been removed from ebay, that should do it.
As for being cautious, anyone who buys off of ebay should be just that.

Your advice is applicable, if I bought a tangible item. However, I bought software, that was "delivered" by email, with a downloadable link, to a Microsoft site. There was nothing "broken" per se. The software downloaded fine. The License KEY "appeared" to be accepted. However, when I tried to use the software, it wanted to be "authenticated" and when I clicked on the Authenticate button, I got an error message saying that "only one authentication was allowed"! My "brand new" License KEY was a fraud!

From what I gather from the initial post, the OP purchased the item and then tried to ask the seller something but got no response. The OP then requested a return, but that was denied because the seller has a no return policy. It appears that the OP has put the cart before the horse several times during this whole business.
1) OP should have made sure that all their questions were answered prior to making the purchase. There is no requirement for the seller to reply to a message, if they actually received one, although it would seem to be a good idea.
2) If the OP requested a cancellation, the seller is not obliged to grant the request.
3) If the OP requested a return and the seller has a no return policy, the seller is perfectly within their rights to deny the request.
4) The OP again placed the cart before the horse, by requesting a return on an item that they were yet to receive. Actually, even if the return request were granted the OP has nothing to return if the item hasn't arrived yet.
One thing I'm somewhat curious about that the OP didn't mention was whether or not they had paid for the item. I must assume that they had, otherwise it isn't logical to request a return of something that wouldn't have been shipped. In fact, no INR dispute could be filed since sellers aren't required to ship before the item has been paid for. I'm afraid that we need some more information from the OP in order to make sense of the situation.

File a not as described with paypal and then PLEASE read the ebay Money Back Guarentee as well as the Paypal buyer protection before you buy anything else, especially software
