If an item is in new condition and has free returns, and I open the box but I don't damage the item, is the seller still required to accept the return?

When a seller offers free returns, they take returns for any reason, including buyer's remorse.
But if the seller is a top rankled seller, bitter and disillusioned, they can withhold up to 50% of the refund if the item is not in the same condition when it is returned.
However if this happens, the buyer can simply go to their payment source to get the remainder of the refund, and the seller will pay a $20 chargeback settlement fee on top of paying the rest the full refund, and losing all fees.

Sometimes this has more to do with "not returned in the same condition as sent".
Buyer can appeal the up to 50% refund with eBay. eBay may choose to make the buyer whole from eBay's pocket. CC would be a reasonable persons second choice. Too may CC claims can cause problems for a card holder.

While the wording of the question tends to lead one to believe that the OP is asking as a buyer, the fact that he is also a seller caused me to ask the question. Frankly, being a seller himself tends to make me think that he is seeking advice on a situation that he is faced with from a buyer.

As @buyselljack2016 CCC is a last resort and not all sellers are bitter or disillusioned as stated by kako, they are simply following protocol and eBay guidelines.
As to an open box, so long as it was not sold as a collectable whereby the original needs to stay in the box to retain the value of the item there should be no problem returning.

Did we just get prankled? It wouldn't be surprising if a top rankled seller is bitter and disillusioned.
And it's OK to chargeback, but not too often, for the remainder of your refund on said rankled seller, e.g. for issuing a partial refund to cover original and return shipping.
Making sure the seller pays, and that eBay does not instead pay the rest of the refund themselves using our fees. (Also, he's a spy, which explains why 007 is not so good on the detective work, wink wink!)
