Buyer received fake Dooney and Burke handbag, #193730437604. Seller wants it back. What do I do?

Simply put, I bought a Dooney and Burke handbag based on poor photos. When it came it was obviously plastic. The seller wants it back but I’m not sure what I should do legally. Item 193730437604. Thanks!

Really?  eBay had experts who could determine the authenticity of handbags by looking at photos?   That astonishes me because I've been here since just about the beginning and never came in contact with, or talked to anyone else who came in contact with, any eBay employee who could or would authenticate anything.  

 

In any event, eBay certainly no longer has this service, so just file the usual INAD, and be prepared to send the bag to the seller.  That in no way makes you a party to anything unlawful in regard to counterfeit items.

Ebay doesn't want it stopped. In many categories fake is the norm. Ebay profits from it, why would they be against it?

I'm sorry but you are confusing two very different things here. You cannot expect a full refund for an item which you do not want to return. Your returning an item that YOU feel is not authentic does not correlate with your "selling" a fake item....

Lucky you. I was on the other end of a similar situation. I sold a used DB purse, that I bought from a DB outlet store in my area, with papers and the cloth packaging. My wife has several DB, LV, MK and Coach, uses them and then sells them after some time. My listing featured pictures of the bag, papers, and the cloth bag to protect it. The buyer never mentioned anything until the last day that he could leave a feedback, and gave us a negative feedback, but he never made a case against us. Since them I've opted not to sell any "designer" type or high value item as there is no way to guarantee the authenticity of the item. 

 

To the OP, by all means, why do you want to keep the purse and get your money. You can't have it both ways. Besides, what exactly is it that you don't like about the purse, you have not mentioned anything. Just return it to the seller. Also, as a side note, you could probably get a similar purse from an outlet store for a little bit more, but at least you can say that you bought it from the store.

I have the exact same bag, bought from Macy's a while back. It's not fake, and if you want a refund, you have to send it back.

 

I suspect what happened is that the bag was dirtier than you thought, and you couldn't get it clean, so you're playing the counterfeit card for a refund.

You bought this bag on Dec. 14, and it was sold as missing its strap but otherwise in good condition.  It cost you about $29 with shipping. 

 

Then on Dec, 24, you bought the identical bag, from another seller, and that bag had its strap, but its overall condition was described as "needing some TLC."  It cost about $38, including shipping.

 

They look identical in the two listings, but the first one you bought you say is counterfeit and, therefore, you want a refund with returning it.   Interesting.

BTW the handbag was obviously fake and good photos would have revealed that. No expertise needed. But the photos were poor.  And vintage Dooney and Burke were not made of plastic but excellent quality leather. That’s why they are still valuable. And I have a lot of them! The newer ones are not as high a quality leather.


So basically, you buy bags, claim their fake, and hope ebay let's you steal them. Thanks for posting

  Then do not buy if the photos are not good.  If I were to come upon an item that I was interested in and the photos were carppy, I hit the back button.

It's interesting to compare the photos of the two bags you bought.  I searched Completed Items for:

193730437604  - first bag bought, which you say is counterfeit
324403826245 - second bag bought

 

For the life of me, I can't see much difference in the quality of the photos in the two listings, so I hope the second bag is okay.

Since you have determined the item is a fake and you are wanting to stop the practice of selling fake items, you should to make a USPS Compliant.  Of course to do this you will have to keep the item and probably turn it over to the USPS for their investigation.  This could take years.  In the mean time I do not think you could get a refund.

That would have been many years ago - when just the word 'counterfeit' would cause ebay to tell you to send it somewhere in Texas(I think) to be destroyed - but instead, we had found out that they were then resold.

I have several comments. (I do know Dooney.)

 

1. Dooney makes some styles in plastic. 

2. Dooney makes bags that are PVC coated fabric.

3. Dooney makes leather like bags. 

 

But the bag in the listing you gave the item number for is NONE of the above. The pictures are very good and for one who knows Dooney, it's a very obvious fake. 

 

Open a dispute for not authentic (ebay's reason will show as "doesn't seem authentic." Seller will have to pay for a return shipping label and for you to get the refund, you MUST return the bag. 

 

There was a time years ago when ebay would tell buyers to destroy the "fake" and provide documentation that the item was destroyed. Buyer got refund and seller lost item and money. 

 

That process was stopped because there were too many cases in which buyers would claim fake for an authentic item and get a refund plus keep the bag.

 

And since ebay doesn't know whether your claim is accurate or not (though it is in this case), they require the seller to get it back in order for you to get the refund.

You are wrong. 

 

The red bag the OP referred to with the braided trim on the flap and the buckle that's covered in pleather is absolutely fake.

That one is fake too. 

 

They're different styles of fakes. The one needing TLC doesn't have the braided trim around the flap and has a different closure but both are fakes. 

 

@dian234  - Now that you've purchased 2 fake Dooneys, my suggestion is to post on the fashion board and verify that your potential purchases are authentic.
