Bought something new that didn’t work

Seller is saying I can’t return it because it is no longer new. His quote “It's not new anymore can't return sorry”. Should I just wait and let eBay step in? I’m too busy to be going back and forth.

Open a 'return' in your 'my ebay' under 'purchases' (blue box). Use 'doesn't work' as the reason. Buyer will have to issue return label, you print it, return it and buyer has to refund. Watch the tracking and return case, once it says 'delivered' back to buyer, they have 2 (or 4) days to refund you. If they don't, return to the 'case' and push the 'ask ebay to step in' button. They will refund you from buyers account. If you don't get a return label (check the 'case'), push the 'ask ebay to step in' button. 

 

Does not matter if seller has 'no returns' on their listing. If it is "not as described", seller has to refund.

Open a Return citing 'Not As Described'. Your seller will get you a refund. Good luck!

I did a return for item not as described but eBay wants you to try and work it out. But that’s not the case. This guy won’t issue a refund. So that’s what I’m saying. EBay will have to step in a force the seller to issue a return right?

They will. There is a timer on your Return. If you don't receive satisfaction by the end time, eBay will step in.

Request a return using the appropriate NAD reason.  If the seller fails to accept the return ask eBay to step in as soon as you are permitted to do so.

Correct,

do not let the time on the case run out or close it until refund

eBay will not step in on its own.  You will have to ask eBay to 'step in and help' when you see the link to do that.  The link will appear in the open case 3-4 days after you opened it. 

 

eBay will provide either a shipping label or the full refund shortly after you bring them in.

No returns does not mean no refunds.

Go to the Resolution Centre and open a  Not As Described dispute.

If he does not send you a return shipping label, you win the case, you will be refunded, and you can dispose of the non-working item as you wish.

If he does not refund willingly, eBay will refund you,  eBay takes their money from his account, he gets a Defect, and his fees may rise, the number and value of his listings may be restricted and if this is persistent behaviour, his selling account may be closed.

 

Although eBay does protect sellers against "changes" to  purchases, to the extent that a refund has been refused because a used garment was washed by the buyer on arrival, opening a New In Box item is not usually considered as a substantial change as eBay interprets it.
