BUYER BEWARE!!! FRAUD

HELP!! I have been an eBayer for 23 years and have 100% feedback. So here is the scam I am stuck in.  I need your advice.... I purchased an expensive trumpet from a seller in Spain.  Instead of sending me a trumpet, he went on Amazon and had an item shipped to a person in my town.  When I register an "item not received" dispute, eBay looks at the tracking number and it says DELIVERED.  So eBay closes the case in the seller's favor.  I reopen the case with and the seller goes in eBay chat feature, pretends to be me and closes the case against him (ebay sent me the transcript of the conversation and I told them it was not me).  I get proof from UPS with tracking number and proof an item was shipped from Amazon to person in my town NOT ME.  eBay doesn't care because the item says delivered.  Is there a fraud department or someone who has some common sense to look deeper?  I have been fighting this for a week.  VERY DISAPPOINTED WITH EBAY.   BEWARE

Just to let you know, every time this has happened to me (around 5 times), I have been able to get the case decision reversed by providing eBay the proof it was not sent to my address. You should be able to as well, it is nothing new and nothing they haven't dealt with before.

You are also covered by Paypal's Buyer Protection.

The PP resolution centre is at the top of your PP account page under Activities.

In addition, if you back your PP account with a credit card, you may also be able to make a chargeback.

If you paid with a bank or PP balance, or if you used a debit or gift card to pay, you have lost your money.

Also, did you drop by the address in your town and ask for your parcel? The recipient may be as confused as you are.

Asking for the parcel would do nothing. Per the OP, the package was a random item shipped from Amazon, not the expensive trumpet they purchased.

That is what I thought but the seller went in on chat and closed the case and eBay keeps closing it because it says delivered to my town.  I have reopened the case 6 times.

Thank you for responding.  The seller sent a similar weight item to someone in my zip code.  It says DELIVERED and apparently that is all the appeals people care about.  4 times I have uploaded the UPS delivery confirmation with the tracking number and who it was shipped from AMAZON and who it was shipped to.  They keep telling me it was DELIVERED to my zip code.

If they could get the package, they could file an INAD.

Thank you for your response.  I have been trying all week.  Uploaded the UPS delivery receipt showing not me and not my address and they keep insisting it was delivered and closing my case against the seller.

I have been trying.  They say it was delivered to my town so they close the case.  The seller has also logged in as me and closed the case against him.

Hi I am sorry this has happened. You need to contact eBay through their Facebook page. The CS reps there will take the time to look at all your evidence, buyers have gotten refunded in your situation.

You leave a message and an eBay employee will get back to you as soon as possible. To speed things up you can leave your registered account information in the PRIVATE message: Full name, address, phone number, email address, user ID, and a brief explanation of your problem. As a security measure you may be asked to log into your eBay account before leaving the message.

I have the proof from UPS.  I have uploaded it and the appeals department says it was delivered to your town and close case.   I don't think I can ask this person in my town for an AMAZON package they received.
