Am I obligated to comply with the seller's requests?

I recently bought what was LISTED as a refurbished Samsung Galaxy Tab A 8" tablet, model T380 (2017 model). It arrived yesterday, and I was pleasantly surprised to find that it was actually a T290, the updated 2019 model (but still a Galaxy tab A, 8", 32gb storage, etc). I also received an email from the seller asking if I was happy with my purchase, to please leave positive feedback, etc. I messaged back and told them about the discrepancy, but that I was NOT complaining as I was pleased to have received the newer model. They sent me a message today requesting photos showing clearly that it WAS a T290, and saying that if it was that I needed to either return the item, or that I had to pay them more money to cover the price difference between the two models.

 

I don't want to return the tablet - I'm happy with it - but I don't feel I should have to pay more for THEIR mistake. Are they out of line? If so, what are my recourses? Should I even do anything at all, or should I simply ignore the message I received from them today?

You have no obligations to the seller once eBay records that the transaction is completed. Not even to exchange messages or leave feedback.

 

That said, only you can decide how you wish to handle things. 

If you have never owned a dachshund, no explanation is possible.

Per eBay rules your not required to pay more.     As stated you could pay the difference if it's in reason. Or ask the seller to send you the correct model and a paid return label for the other one and you will return it after you receive the correct one. 

 

Buyers can file a case if they receive the wrong item. However, there is no such case a seller can file. There is NO I send the wrong item and want it back.  Nope, that is the seller's problem.

1. What is ebay's position with regard to this matter ?

 

2. Is the financial compensation the seller offers, payable in advance, to compensate you for the investment of time & effort to comply with their request to return the item satisfactory ?

I don't  believe you can be forced to return it but you did receive something sent by mistake. If you received a different cheaper one you'd say it doesn't match and you'd return that for a refund or the right one wouldn't  you? 

 

Because you see it as a windfall of course you're happy to keep it and you want to keep it. I believe you're going to keep it. I wouldn't  enrich myself through someone else's misery.  Put yourself in their shoes. 

 

You mentioned not wanting to pay more for their mistake. Paying more gets you more.  Or you could return it which won't cost you anything and  have them send the one you bought, or you'll have the money returned to buy another TAB A.

I believe I'm wasting my time. You either have a conscience or not.

It's yours.  You don't have to do anything.  And I wouldn't.

 

See, what the other boardies don't understand or are unwilling to comprehend is that when the seller messes up, it's ALL on the seller.  

 

I just bought a new computer. The ram was supposed to be 32, but I received 64, the hard drive was supposed to be 1 terabyte, I received 5 terabyte, there's some other upgrades.  Basically they sent me the gamers version, when I ordered the business version.  I'm assuming the manufacturer ran out of prebuilts in the configuration I ordered and sent me a better one.   

 

The serial number matches the packing slip.  The manufacture knew.

 

Same computer, better bios.  I'm keeping it.

I'll bet they pre-loaded Windows 10 on it, though.

You don't have to do anything. I would offer to return it at the seller's expense, but on the flip side of the coin the seller should let you keep it because it was their mistake. But you're not obligated to do anything.

I don't see where the seller offered any financial compensation.  On the contrary, he is requesting either more money or return of the item.
