I ordered an item yesterday, and the seller almost immediately opened an "item not received" case for me, and it says that I opened it. I didn't know eBay sellers could even do that! The seller then contacted me, asking me to close the case (which I didn't do because I know that if I close a case, a new one can't be opened). I know that my account has NOT been compromised, because I would've received a sign-in email, and because the seller would've been able to press the "close this request" button for me if they had access to my account.
The seller provided a tracking number. When I put it into the tracking on ups.com, it says that the item has been delivered today to my town, but not to me. This counts as a delivered item in eBay's system. The case says that it will automatically close after 24 hours, since the item is marked as delivered.
I contacted eBay support by phone both before and after the item was marked as delivered. When I contacted them after the item was marked as delivered, the representative told me that the case will NOT automatically close in 24 hours, and that it was the "seller make it right period", despite what it says on the request page.
The request page also has an "ask us to step in and help" button, but it says that there is a technical issue when I try to use it. The representative said that this is happening because it is the "seller make it right period".
Which one should I believe? The request page, which says that the case will close in 24 hours, or the eBay representative, who said that the case will NOT be closed?
There is also a return button for the item, which will become available tomorrow, but I don't think that it'll help, because I haven't actually received anything.

No, a seller can not open an INR, only the buyer can.
Now, I have heard of some shady sellers contacting CS claiming to be the buyer and having cases opened.

Maybe that's what happened. But why would eBay agree to open an INR case for an item that was ordered less than an hour ago, and initially had an estimated delivery date half a month out?

Now that I think about it, that's probably exactly what happened. When I called eBay customer support, they asked me what my name is, presumably to verify that it's me. The seller knows my name because it's in my shipping information, so they could've easily pretended to be me.
eBay really needs a better verification system for phone support.
