eBay refunded a customer who abused the returns policy

Who has had this experience?  eBay says you as a seller need to accept a return from a buyer you have proven is abusing the returns policy on a No Returns listed item.  I had an issue with a buyer last December who was reselling my items to his customers, but doing it incorrectly and items were claimed not as described.  That was true for him, not me.  I proved to eBay that the guy was scamming me and they told me if I accepted and documented the return they would refund me for everything including the return shipping and sanction the buyer who was reselling, a violation of eBay policy to resell from retail to retail.  
I received the item, badly beaten up from all the trips it made, documented that the item was in fact as described and reported the same to eBay.  Their response to me was to refund the buyer and I was screwed for all of it.  That buyer is still to this day reselling items on ebay from Costco, Sam's, etc. 
Now I have a customer who claims an item was not as described and the listing photos do not match, yet she included a photo that matches my listing exactly. She returned the item, I reported the abuse of the policy and this morning eBay refunded the buyer and took the money from my account. 

Who's interested in starting a Class Action Law Suit?  I already received a judgement for $5000 for the $150 item I sold last year that eBay screwed me out of.  Of course eBay is appealing that case.
