eBay not helping with counterfeit item?

I’m very frustrated and do not know what to do. I only buy authentic items and purchased what I thought was an authentic Louis Vuitton bag in July 2021 on eBay for which I paid $1700. Fast forward to December 2024 when I decided to sell the bag on Fashionphile as I rarely used it and was informed the bag is a counterfeit. I immediately contacted eBay and they are telling me I have to settle the matter with the seller who after agreeing to refunding me is no longer answering my messages.

 

Does anyone have any recommendations on how I can resolve this? I understand I didn’t do my due diligence although I’m not really sure where I could have gone to self authenticate and I was under the impression that eBay authenticated items like other marketplaces (Poshmark).

Ebay has a 30 day Money Back Guarantee.

Since you made the purchase 3 1/2 years ago, Ebay can no longer assist you.

I’m so sorry this happened, but eBay‘s Money Back Guarantee is good only for 30 days from date of delivery. I’m afraid you will have to go to a small claims court for help.

Hi @house*of*paws I spoke to a customer support representative on the phone who was a lot more helpful than the online agent. I hopeful I won’t have to go this route but if I do, do you mean sue eBay in small claims or the seller? The issue is I don’t have the sellers information and eBay will not release to me.

Since you purchased from the seller, you will have to take the seller to small claims court if you want to pursue the matter.

Keep in mind that you would also have to prove that the seller knew that the bag was a counterfeit.  The court could hold you partially responsible for the loss given the time since the purchase.  You would also have to go to court in the sellers jurisdiction and if you win it is up to you to find a way to collect any judgement.

The messages I’ve exchanged with the buyer lead me to believe they were aware the item was counterfeit and I do have proof from Fashionphile as well. I really would like to recoup my loss but ultimately I would also like to prohibit the seller from defrauding another buyer but it sounds like since its way past the 30day mark that is not an option?
