You are correct! The SELLER is the one to cancel the transaction.
They are trying to get you to lie in order for them to avoid an Ebay defect.

You can reply to the seller that you don't want to cancel the order - you want the item you purchased. If they don't have the item, then as they already know, they need to cancel using the reason that they are out of stock. Misrepresenting the reason for the cancellation is a reportable policy violation.

Should I do what eBay advised yesterday on the phone? They said I could wait until Jan. 17th and then file "Never received item". I just think it's odd the Seller wants me to file a return for an item I never received because they did not have it. This seems so dis-honest on the Seller's part. The Seller said that eBay told him not to cancel the order...HUH? He doesn't have the item....of course he should cancel & refund me right away. Why would eBay tell him this unless they favor the Seller over the Buyer. Now he says he didn't get paid but on my side it shows I paid the same day I bought it. HELP! JH

Sounds like it may be a new seller who doesn't know what he's doing... eBay would not tell the seller not to cancel the order. He either mis-understood or he's not telling the truth.
You can follow my advice and if the seller doesn't perform, follow eBay's and report an item not received after the estimated delivery date passes. (DON'T file a return - you don't have anything to return.)
