Preorder item never shipped

Seller stopped responding, and the item is available, but seller never shipped. eBay says I’m not eligible for a refund, because the window closed for me to open a case.

You’ll have to file an ‘Item not received’ claim with either PayPal or your credit card company, since you passed the deadline for filing one with eBay.  Hopefully, you’re still within their deadline for filing one.

This is the first paragraph on the page. 
“Presale listings must clearly state that they are "presale" in the title and description, and guarantee shipment within 40 business days of purchase”

Yeah, I was hoping eBay would provide a better answer, since this was a preorder. But thanks for the answer… 🙏🏽🙏🏽

I filed an appeal, and actually spoke to an agent. Because this seller was in clear violation of this. And never shipped my item, and stopped responding to me. No wonder they have tons of negative feedback recently… Ugh😞
