eBay charges tax according to the laws of the state the item is shipped to.  All of the tax monies are remitted to the state.

Tax is collected automatically.  Sometimes when an 'exempt' item is taxed ... it is because of the Category the seller listed it in.

For example:  If a state exempts used clothing from taxes ... eBay will NOT collect tax if a used football jersey is listed in the Clothing Category ... but WILL collect tax if the same item is listed under Sports Memorabilia.

Ebay collects the tax on behalf of YOUR state, so you will need to contact the Pennsylvania Department of Revenue to lodge your complaint.

What a world we live in.  I recall in my youth in NYS, some small pharmacies collected sales tax on aspirin and other over the counter medications to unsuspecting customers....  Guess where the tax money went....

The individual states DO audit the sales tax that Ebay collects and the states make sure they are receiving every penny that Ebay collects on their behalf.

I am a bookkeeper, so every quarter I have to file a sales tax return showing all taxes collected per county AND state and remit those taxes collected to the appropriate tax authorities. I am sure Ebay has well paid accountants that do the same. The states will gladly enforce penalties for underpaid taxes reported.
