How can a seller accept your offer on said item and then turn around and sell it to someone else. It’s showing pay now but when I attempt to pay it stating item is not available, is this common practice or is this just a scam? I never had this happen before, will I be penalized for this because of the pay now request? How can this happen?

Actually, the issue is NOT with the Seller, it is eBay's new programming that lets the original listing stay active at list price and if someone comes along an buys the item before an offer is paid for they get the item.
You can request a call back from eBay and complain about this new feature: eBay Customer Service
