Chargebacks can be used whenever the buyer and their credit/debit card
agree. That's just the way it works. A purchase that is not honestly
described can be chargedback.
That's a decision to be made by the buyer and her funding source. The
seller's opinion isn't a part of the decision. Chargebacks for items
that were not honestly described are quite common.

I'm sorry this happened to you. Have you considered a chargeback? You
might want to talk to your credit/debit card company or buy your own
label and send it back with tracking. I am very careful about buying on
Ebay, I've been burned a few times too.
