item ordered wasn't as pictured, so i opened return case, and contacted seller,
he told me he will send me proper item if i close return case first
i know i can't reopen return case once i close it....
we comunicated over ebay messages,
my question is: If i close return case, and don't recieve replacement, i also can't recieve refund,
so, will ebay staff have access to my messages and be able to protect me,and understand i closed return case because i was asked?
Note: it is kind of a grey area if he should resend or not (2 out of 6 pictures were of the proper item, and 4 out of 6 images on lisiting were of something else i thought i was buying-those were zoomed in, so i looked at those because it has more details)

@myboardid You might not know this, but that is a policy violation according to a blue that posted here in the past. He specifically said asking a buyer to close a case is a violation and when they read the messages that is grounds for you instantly lose the case. I'm not sure if its true, it might be another hidden policy. Just saying....

Just say you want a refund, nothing more. If a return shipping label is not provided, ask eBay to "Step in" on the 3rd business day. Sellers (especially China sellers) know that if eBay steps in they get a defect. That's death for many sellers in a short while. I'm sure the seller will just refund you without having to return the item, that's what most China sellers do (they know its cost prohibitive to return stuff to China).

And this is exactly why the seller wanted you to close the case so he can 're-ship' another. Seller is responsible for return shipping on an eBay Not As Described claim. Shipping from China to the US with tracking is cheap. Shipping from US to China with tracking is EXPENSIVE.
Seller is trying to get you to close the claim or delay your claim so it times out naturally. While a claim can be opened through PayPal (if that's how you paid) if the seller fails to honor his word (replacement of damaged item), PayPal requires the buyer to ship it back on their dime - which is cost-prohibitive. Seller knows this.
This is nothing but a ruse, and unfortunately far too many buyers fall for it. You know better. That's why you came here. It was fishy. Don't fall for seller's deceit.

I had no idea - I evidently never saw that post. So how would you go about the replacement as a seller? If I let her return the item, eBay would immediately force a refund. She could buy it again but that takes too much time, or if she buys it again right away before the return process is complete, it ties up her money twice. At one point there was an option to ask for a replacement - what happened to that? I only want to make the buyer happy, but not by giving her a free replacement.

I have no idea how you go about it with the limitations that they put on us. I found out the hard way about it. 😉
