item ordered wasn't as pictured, so i opened return case, and contacted seller,
he told me he will send me proper item if i close return case first
i know i can't reopen return case once i close it....
we comunicated over ebay messages,
my question is: If i close return case, and don't recieve replacement, i also can't recieve refund,
so, will ebay staff have access to my messages and be able to protect me,and understand i closed return case because i was asked?
Note: it is kind of a grey area if he should resend or not (2 out of 6 pictures were of the proper item, and 4 out of 6 images on lisiting were of something else i thought i was buying-those were zoomed in, so i looked at those because it has more details)

You can insist that he pay you ahead of time for the return shipping. If he refuses, ask eBay to step in as soon as they will allow you to do so, and they will give you a full refund without you having to return the item.

Sounds like your seller is trying to pull a fast one on you. Skip the replacement and get your money back, you don't want any further dealings with this seller.

Don't close it.
That's a common ploy by sellers to make cases go away.

If you close the case, you will get NOTHING. NO replacement, NO refund.
Get your refund and be done with it. And YES, Chinese sellers do this all the time. They will drag their customers well past the Ebay deadlines so no feedback can be left and no repercussions will be felt on their accounts.
GET YOUR REFUND...or get nothing. Your choice.

The sellers account wouldn't be closed over this there is little to no risk in manipulating buyers to close a case early. Do not do it. I figured when I intialy read this it was a Chinese seller and now you've shown that too. This is a very common ploy among Chinese sellers. You will close the case and get nothing

If you close the case, ebay will do NOTHING to help you after that. Doesn't matter whether or not ebay can see your messages. If the case is closed, it's closed. Period.

The seller is telling you to close the case when you already know you can't reopen once it is closed.
Why even entertain anything further that this seller says, or put any trust into eBay reps backing you up if you chose to close the case?
Relying on eBay to understand and act on anything, be it member-to-member messages, resolution cases, or even their own policies is a losing strategy.
Keep the case open until you get the refund then move on to a more reliable seller.

This is exactly how they scam people. He's probably dione it so often he's at risk of being suspended from selling and doesn't want to have anther case closed against him.
This is how they operate and why so many people are upset about them getting away with it so many times.

Don't close the SNAD case. Simply take the refund and find a new seller. Do NOT accept a replacement. Its a common stall tactic for China sellers.

First, I agree with those who say no, don't close it, but specifically because the seller is from China, and those Chinese sellers have a bad reputation for scamming buyers in this way.
That said, I was just in the same situation with a buyer (I'm the seller). They opened a return request for an item that was broken in transit but wanted a replacement. There was no option on the return case for me to just send a replacement, only for her to return it at my expense and get a refund. So I asked her to close the return request, which she did, and I sent her the replacement immediately. But then, I am an honest seller, and want to have happy buyers.
