So I have been in communication with the seller about sending my item. They said they would send it yesterday and they still haven't, its been 7 days. They said on their auction they stated that it will be sent out 5 days. Well there is no such claim on the auction worded by seller. In a earlier communication they told me that ebay allows 5 days for mailing. I've been a seller myself for awhile and I usually send items the day its sold, also I know for a fact that you have 3 days to get the item mailed. Anyway tomorrow is the ebay date on when I should have recieved the item, should I file a not recieved item in paypal, I feel its the best route to take. I also can't believe that this sellers feedback is all fast shipping great item, yet they are dragging their feet with my item. Well guess they need a new red color in their feedback, I'm so inspired let me tell ya.

I didn't read it, I just assumed a seller should get the item out within 3 days, I've never heard of a week and nothing. When I sold things in the past I'd send them out within a hour, but maybe ebay doesn't have a time limit the seller has to send it. Just the same, it would be respectful if the seller would just send it instead of playing games.

No, you said, " . . . also I know for a fact that you have 3 days to get the item mailed."
I'm just curious as to what you read (or heard or by whatever means) that supports your conclusion enough for you to present it here on this discussion board as a "fact."

The seller chooses his handling time, eBay doesn’t require shipping within 3 days and never has. If the seller hasn’t specifically told you he hasn’t shipped, then don’t assume anything. He’s not required to mark the item shipped and upload tracking.
Ebah gives you an estimated delivery date. You don’t need to contact the seller prior to the that. If your item doesn’t arrive and that date comes and goes, just file an item not received case in the resolution. It’s not like you can take abu action before that date so there’s no need to get into with the seller and fret over lack of shipping before that date.

As Jen stated, file your INR, but do it on eBay, not paypal. You should always file first on the site where you made the purchase. That way if it's not properly resolved you have a second avenue to pursue.

k then, I'll just file it through ebay and let the rest take its course.

Today when I tried to go the item not recieved route ebay said to go to community forums or contact seller.
since ebay offers me no option on -item not recieved, I might have to go through pay pal.

You have to wait until tomorrow before you can file an INR complaint with eBay.

What is the estimated arrival date? Never mind. I found it. Thats correct that you have to wait until the last estimated date is passed.
