I did not receive my item I won in a auction. After the delivery date passed I opened a dispute online only to be told i no longer qualified for the money back guarantee even though it had not been 30 days since the delivery date. It was only 2 days. I called in to start the dispute the agent placed my complaint as a return instead of refund. I have been goig back and forth since 9/8 trying to get my refund. I was told by one agent they ruled in my favor due to the seller not providing tracking information and i will be refunded. After waiting 2-7 business days I called back only to be told I would not receive a refund. I got transferred at least 3 different times that day only to get to a final agent that states I will receive a refund minus .69 charged by the seller. I am not sure why the seller charged me for a item he never shipped since he never responded to any of my emails asking for tracking information for my item. But as of today I still have not receievd my refund nor my item and I am not sure what to do from here becaue customer service is no help at all.

@ladysts, when you didn't get the item you ordered and your refund is taking too long, you need to go to where the money is. Open an "item not received" dispute:
http://paypal.com/disputes
Then go back and immediately click Escalate to PayPal.
Ignore if your seller contacts you now, do not close the case, and just wait for your refund.

I tried to but it told me my order no longer qualified to the money back guarantee. I called in and the agent opened the dispute for me but he put it as a retun instead of a not received so ebay is giving me the run aroung like I submitted the case wrong. I asked them to pull the call so they can see I was calling for a "not received". I also explained the money back guarantee is for items not received 30 days after expected delivery and I called in 2 days.

Again, you need to abandon your case at eBay, and instead open then escalate a dispute at PayPal.

Try opening a case with PAYPAL (as tarpedge mentioned) and not ebay.
