malicious method.

Seller sold an item that needs to be returned and claim that the returned item is broken.
It's an extremely malicious method.

 

 I wrapped it firmly and returned it with a cushion.
The packing method is the same as seller sent.
I took a picture before shipping.

Fragile is also attached at the post office.
There should be no problem.
seller complainted me and not refund money.

I would sue the seller

What was the reason for the original return? What kind of case did you open?

Have you appealed the sellers decision to eBay.

If you paid with a credit card you can file a charge back if you have exhausted your options with eBay and PayPal.

So you are the buyer, correct?

I'm not sure what you consider malicious about the return process used by eBay.  If the item arrived damaged you simply need to request a return using the appropriate reason and the seller is required to pay the return shipping.  If the shipment was a domestic one, the seller usually has eBay send a return label.

 

Frankly, pictures are useless as any type of evidence of anything and I don't understand why you would mark a damaged item return as fragile since the USPS usually charges extra for that, I believe.

 

Did you follow the procedure for a NAD return as set forth in the MBG?  Does the tracking show that the return has been received by the seller?  If you followed procedure and the seller fails to refund your money you need to ask eBay to step in.

 

By the way, law suits in cases like this are usually not economically feasible.

I see that you have already left negative feedback.  You seem to be saying that the seller is claiming that the items arrived damaged and that is not the reason you used when filing the return request.  Is that what is going on? 

 

As I previously mentioned, eBay will not accept photographic evidence of how you shipped the items back to the seller.  That is their policy.  I'm still not understanding your "malicious method" comment either here or in your feedback remarks.  Did you received broken items or were the items somehow damaged on the return to the seller?
