Hi, May be you have not seen recent eBay system upgrades. There is no longer free access to the eBay Money Back Guarantee as far as the estimated delivery period is running. Keep in mind the displayed delivery period in the purchase history webpage is set by the eBay system independently of the seller. This has been agreed is a recent post about items never received by the carrier. In addition, I discovered that this period of time is repeatedly updated on late deliveries and becomes wider until the famous 60 days is contained into it. This 60 days deadline is commonly known to put an end to most tracker, is a lost criteria for most worldwide postal companies and is the limit for the purchase history webpage. Therefore the conclusion saying that sellers are free to keep in house both the item and the buyer's money for at least 60 days for his own business is not affected. You have to understand that the estimated delivery period is a fake created by the eBay system and the eBay system only. I never took care of this until some major decisions like the free access to the resolution center was driven by this fake. The PayPal process is now a clone of the eBay system. If the delivery period is running then PayPal provides a link to the eBay page that claims "Your item is on its way" which is obviously wrong since the item is not received by the carrier.

Thanks for your fruitful comments. I have similar problems with UK sellers. May be you don't like Chinese people who provide the vast majority of innovative products to the world. I would agree with you to stop eBay making business with China and then to limit eBay to local business. Anyway that doesn't affect my conclusion.

Not sure what you mean by that, it doesn't cost anything to use the Resolution Center.
If you don't receive your item by the last estimated delivery date Ebay gave you, the next day, go to the Resolution Center and select, I haven't received my item.
If tracking shows the item hasn't been delivered, you should get a refund.

That's on the way. I'm naive and I always give a chance to the seller until the 60 days deadline is over. Anyway, this is not the topic. If eBay allows such seller's behavior then all the eBay community has to be aware this is permitted and legal. Then if I'm a seller I want to make legal and easy profit at eBay keeping both the item and the buyer's money and I would expect everyone doing the same at eBay because this is fully permitted. If eBay confirm that's the right rule then I'm happy.

I mean the basic law and other worldwide commercial regulations say: what is not forbidden is permitted and legal, OK. eBay provide the opportunity to the seller to keep both the item and the buyer's money during 60 days at least, OK. That possibility exists right now and should be formally granted by eBay as a normal eBay rule valid for everyone, OK. That has nothing to do with the Chinese people you don't like. That's a problem from eBay and about the usage of the fake estimate of delivery dates, OK.

You keep talking about a "60 Day deadline"
The eBay MBG is valid for 30 days past Delivery or Estimated Delivery Date (whichever comes first). Not payment date, not shipped date ... The Delivery Date is what the deadline is based on.
Tracking does not stop after 60 days either.
You can open an Item Not Received case 1 day after the Estimated Delivery date ... for up to 30 days past that Date.
You can open an Item Not as Described case as soon as the item is delivered ... for up to 30 days past the Delivery Date.

That doesn't affect my conclusion. I have an item with a delivery period arbitrary set to about 60 days by the eBay system. Obviously, this item has never been shipped. The first 30 days deadline from the purchase date is today. The not receive case is, of course, rejected. I have to wait 60 days as previously stated.
I have to dig out the record of the tracker claiming the tracking is stopped after about 60 days without any update. The same for blog/forum talking about the waiting time the postal companies consider the parcel is lost. Thanks for your help.

There is no deadline on eBay from PURCHASE DATE.
All Deadlines are by DELIVERY DATE or LAST ESTIMATED DELIVERY DATE.
Go to your Purchase History
Look at the Estimated Delivery Date
If that date has passed, use the drop-down menu next to the item and select "I have not received this item"

If the seller does not respond, then you can ask ebay to step in on the 4th day.

If it has been over 30 days since the Delivery Date passed, you can file a case with PayPal or your Credit Card, depending on how you paid

Hi, That's what I said. The delivery period is arbitrary set to about 60 days by the eBay system. 30 days is passed and I have to wait 30 days more to open a dispute.
I open a dispute every 2 months in average for delivery issue. The last time was this afternoon against a UK seller. This is exhausting, believe me.

Delivery Estimates are not arbitrary.
They are based on the seller's handling time, the carrier and method of shipping in the listing and distance between Seller and buyer.
All Estimated Delivery Dates are shown in every listing BEFORE you purchase. It is right under the price of the item. You can also look at the Shipping and Payments section on the listing to see it.
If the delivery estimate is too long ... find a different seller ...
Sellers are not required to use tracking. They are also not required to ship immediately -- they may have a handling time than can be anywhere between "same day" and 30 days.
As a buyer all you need to worry about is the Estimated Delivery Date.
