eBay sided with buyer with no input from me

I sold a rare and discontinued perfume which was brand new and never sprayed. My listing states a no return policy however the buyer got the item and said the fragrance was not authentic and wanted a refund. I photographed a receipt of the purchase from an authorized dealer proving its authenticity. She then claimed ”it faded too fast” and opened a case against me saying my listing was inaccurate and wants a refund and for me to pay her shipping! Of course eBay sides with her without hearing from me. Now I have an expensive bottle of perfume which is no longer new as she sprayed it and I can’t sell it for the same amount. How is this fair? How can eBay grant her a refund on the basis my listing was inaccurate because the perfume faded too fast? I’m waiting for her to ship it back and I’m expecting half of it to be gone. It seems like a big scam (she could’ve poured half of it into an empty container) or she has buyers remorse. I am

outraged by Ebay’s handling of the situation.

eBay almost always sides with the buyer. To add insult to injury- you will receive a seller performance strike on your account for not proactively accepting the return and letting the buyer ask eBay to step in.

 

Wait to see what you get back then come here for advice.

When you make a sale you set up an implied contract with the buyer. If the buyer files SNAD eBay has to assume that you violated the contract and undo it as best they can. The money goes back to the buyer and the item to the seller. Seller pays for shipping as they are deemed to be the professional.

 

The terms of the contract (no returns) are not enforceable if you possibly violated the contact by sending a SNAD item. The buyer could get exactly the same result if they filed with their credit card only you would be assessed a chargeback fee too.

 

If the buyer opened a case their return will be on ebays radar and they will be kicked out of the MBG if they file too many returns.

Whether the buyer is right or wrong there is nothing you can do to win a return anymore.

I had this happen with a pair of jeans. I stated the description of them and the correct inseam length. This person failed to read obviously or ask a question like a responsible adult. The picture of the tag said 28R but the inseam had been hemmed ( I failed to read the description, the only time I ever have and they were to short for me) She wanted a partial refund and then harassed me. Who did ebay side with the irresponsible buyer. It is so frustrating when we do everything correct and the buyer gets away with things like this! Glad I am not the only one aggravated with ebay!

If the buyer has to ask a question the seller is not doing their job. Buyers should not have to ask questions unless they are weird unexpected ones.

 

BTW I looked at your listing for the Ariat jeans and it was not obvious anywhere that they had been shortened. That should have been in the title.

A NO RETURNS policy is only good for buyer's remorse returns.  The buyer has, by using the authenticity reason has claimed a SNAD and is covered under the MBG.
