eBay buyer reported item damage

Buyer reported item damage, show a picture and then I ask for more pictures and the item was further damage by the buyer on the second set of pictures. He opened a claim and ebay (obviously) automatically sided with him. 

 

Is there a way to appeal as he has made purchases of similar products from other sellers. One seller told me, he too (same buyer as mine) made a suspicious damage claim on her listing too.

 

Possible scammer but can't call ebay cause phone service doesn't work.

On the bright side, the buyer sent you photos you can use to file a claim, right? Buyers aren’t always so cooperative.

Have you received the item back?If you can not prove buyer damaged(buyer would have to admit it)you can not win an appeal

I've had buyers replace their broken item with the one I sold them... then claim damage or item not as described.  One thing I've learned that I would like to pass on,  is this:

When selling anything with a serial number,  include a closeup listing photo of the actual number, as it is, on the item.  Also include the serial number in your description area, as part of the item's description.  Since I've been doing that, I haven't had anything with a serial number disputed as "damaged" nor returned.  It apparently makes your buyers real honest (re swap outs) right up front!  LOL

I just file an insurance claim if the buyer is claiming damage. I insure through Shipsurance. They ask the buyer to complete an online affidavit; that usually that brings out the honesty in a buyer. Dishonest buyers withdraw the cases with some excuse. Honest buyers complete the form. PITA buyers refuse to do anything to help, so I refund them and call my insurance to tell them my buyer refuses to provide anything.

 

Did you insure the package? If not, I would let them return it and then call eBay with your evidence to fight the claim.
