do i need to close a return in order to get a refund?

Hi,

long story short

wrong item was sent and now we made a deal that the seller will refund me %75 of the price

now i have started a return case, and he says i need to close the return case first in order to get a refund through paypal?

paypal is holding him back because the 'return case' is still open

is this true?

because after i close the case i can't ask ebay for help

NO, NEVER close a case before you get  a refund!!!!!  DON'T make deals like this!

 

I believe you opened a SNAD case, significantly not as described.  

 

YOu can respectfully tell the seller that you checked Ebay rules and it doesn't work that way.  You will have no recourse if you close the case, and he can refund  you or Ebay will do it.

 

Seller can request the item be returned, but they pay return shipping and send you a label in the case.  You have five days to get the package in the mail.  You print the label, attach to package, arrange a pick up online and send it.  When tracking shows delivery, you get your refund.  A full refund of your purchase price and original shipping.

 

Seller can also just refund without a return.

 

Please consider reading up on the Buyer Protection policies for your own protection.  It was great that you questioned this, though, and didn't just close the case.

but we made a deal that i keep the item and he pay back %75 of the price

but in order for him to refund me i need to close the case (he says)

is this true?

Yes. That is true. Your seller cannot make a partial refund with a case open.

I should specify that the seller cannot do a partial if a RETURN case is open.

Have him send a partial refund via PayPal. THEN you can close the request.

No. The paypal transaction has been frozen and the seller cannot issue a partial if a return is open. I know this. I had to deal with this recently.

A return should never have been opened. It handcuffs the seller when the seller is trying to take care of a problem.

With a return open the ONLY choices are full refund or return for refund.

 

The OP is left with trusting the seller or not. There is nothing further the seller can do to comply with what was agreed on unless the OP closes the return request.

The OP should be advised NOT to close the request then. The seller can offer an official partial through the return request and it can be processed that way.

I'm sorry but as I already said, that isn't true and you don't do deals.  Keep the case open.  If the seller doesn't respond, you ask Ebay to step in.  Seller can request a return and pay for return shipping and you get back your cost and shipping.  OR he can refund you your full price and shipping and let you keep the item.  DO NOT CLOSE THE CASE!  Let it play out and ask Ebay to step in when they say you can.  I think it is in three days.

That's my thought.  If the OP closes the case, seller has no incentive to issue the refund.  And there have been some sellers known to ask you to do this and it has been advised many times on this Board not to close a case even if the seller says that is the only way they can issue you a refund, because then you don't get your refund.

No. If you close the case, you will receive nothing and won't be able to open a new case. Don't fall for it. Have ebay step in and help when you are able to do so.

There is a  return process for a partial refund now
Buyer opens return & it is a 1 shot deal the  seller offers Partial

I guess If I was going to do this I would use ebay messages first to agree on the amount & then send my 1 shot.

You can only offer a partial refund once, and the buyer can choose to accept or reject your offer.
