do I have to refund?

Sold a new sealed dental drill to

a licensed dentist. He said he used it and it seized during surgery. I asked him to look into getting it repaired for a partial refund. I sent it new sealed sterile and getting it back used sounds gross.

What would you/expect if you were the buyer and your purchased a brand new item that didn't work?

I would have him return it for a full refund if he doesn’t want a partial refund to cover the cost of repairs. eBay wouldn’t enforce the item condition clause here because here are situations in which the buyer has to use the item in order to know it’s defective.
