case opened--item not received

Well, with all the items running late, I knew this was going to happen.  A buyer opened a case of item not received.  It was shipped first class 11/27, not delivered as of 12/5.  I have been working with this buyer, keeping him updated on the emails I received from the USPS.  I opened a case with the USPS and am waiting for a response.

 

This is my first item not received case.  I responded with the tracking number.  I know if eBay has to step in, I get a defect.  Don't want that to happen.  Tell me, how many days do I have to take care of this? 

 

He has already purchased this item elsewhere and now doesn't even want this one.  Should he refuse it when it does finally show up so I get it back?  I don't want to refund and then he gets to keep this item and the money.  I also don't want to refund and then have him open a return case and refund again.  I need advice.  Thanks.

Reply to the case with the tracking number. Ebay can see it's on it's way and may allow some extra time on that case.

Ebay gave you a date by which they may step in if the situation is not resolved. What is the date? Until then, you don't have to do any refund.

 

I would ask them to refuse the package and hope they are honest to do that and will not keep the purchase.

@martin2001 Actually eBay did not give a date.  All I see is when it was opened and the messages sent/received, nothing else.

Just got another one opened.  I am sick to my stomach.  eBay, help your sellers!  It isn't my fault that your estimated dates are WAY off.  I spoke with a USPS employee by phone last week.  She looked at some of my tracking.  I told her that priority says 2-day from Ohio to California.  She literally laughed!  She said even Priority Express isn't running at 2 days.   I told her that eBay sellers were responsible and are paying for their mistakes.  She said 'put a disclaimer'.  I told her that means nothing.

I had so many usps first class packages arriving late I had to switch to UPS ground. So far I have lost over $300 due to the postal service delivering late.

Can someone answer a question for me:  If I refund these item not received cases, how do I get my item back when it is delivered??  If the buyer opens a return after a refund, does eBay refund them again?  These are the first cases that I have ever had of item not received so I am lost.  Someone help.

You will only get the delivered-after-refund item back if the buyer sends it back because they are honest.
