Bought some military gear from a seller who told me he would ship them in three seperate packages. He shipped two of the packages twenty two days later. Twenty days from when those two packages were shipped, he still has not shipped the 3rd package. I don't want to be rude but its been a while. I have been asking him to ship and he tells me next week or what ever date and it does not happen.

The only thing you can do is file an item not as described case, not an item not received.

Forget being rude...you need to act now and open an "Item Not As Described " case under the MBG. As in, NOW.
You didn't get your full order. You only have 30 days past the last Estimated Date of Delivery to file a claim and it sounds as if you've wasted approx 20 - plus days to have gotten your money back.

Wait... If I understand correctly, the seller shipped 2 orders 20 days out...and hasn't even shipped the 3rd... You may have actually missed the window to file a claim while waiting for that clown to ship your order piecemeal...

Yes... You won't get a refund while holding what you did receive. The seller will be made to send you a mailing label, you return the partial order and then a refund will be processed when the seller receives the item.
All of this is null and void if it has been 30 days beyond the estimated delivery date.

I just put in a "Item hasn't arrived" case so hopefully the seller will now have open time in his day to ship the third package. I had purchased items from him in the past which arrived very quickly, so this was quite odd. It looks like the countdown timer for the 30 day window starts after the first package is delivered. So I have until the 26th to return it.

You are supposed to file an item not as described claim.
That was clearly stated in my last post.
You filed the wrong claim... You did receive a partial order... Hence the reason an INR was the wrong claim to file.

Yes, if your seller sends you return shipping labels. The seller may be willing to offer a partial refund; the seller may also not respond to the case and you'll be refunded without returning after you escalate it to eBay. Watch the case.

Unfortunately, Ebay won't step in until the 18th as they want to give the seller time to respond. So I have to wait six days until I can ask them to step in. Thanks for your help, I probably would have waited out the time to file a claim without you. Thanks.

That's cool, but...
Since you went ahead and filed a Item Not Received... Even though I and one other poster specifically told you NOT to, Here's what happens next:
EBay will ask the seller to provide proof that he shipped your order, and all he has to do is upload the tracking data that shows the items that WERE sent to you got " delivered" to you, and his job is done - and you will receive nothing more. He can ship the rest, but only if he wants, but now he won't have to.
again... You received something. An INR only works for you if you received absolutely nothing.
