What happens if seller refuses return by not signing for package...?

So I'm getting worried now....

I won my escalated Ebay case on a fraudulent item I bought (and received) last week (March 30)

I promptly sent it back last Weds. (per Ebay's signature label...), tracked it, and it was "attempted delivery" to address (last Friday) but nobody was home.  I have received no other information since.....

My question:

If the postal carrier could not deliver the package than the item never physically reached the seller, therefore the seller did not refuse delivery?  USPS said package will be  returned to the sender on May 1st if seller does not retrieve item.

I know I still have some time this week to wait....but emailing the seller is worthless since he/she knows they lost...

So does Ebay automatically refund me since seller may not "physically" accept the return??

Thanks for all your help...

Should the seller never pick up the package, ebay will refund you as they can see that a delivery attempt was made. You did everything you were supposed to do. Sellers cannot get out of issuing refunds by not picking up or refusing a delivery.

Keep in mind with what is happening now with many states having stay at home orders, people may not be going to a post office as quickly as they normally would. Since the attempt was just on April 3rd, I wouldn't be too concerned at this point.

Thank you for your prompt reply....

I guess my final question is...

When will Ebay refund my $$?  (few days, weeks..?).   The reason why I say this is because I already have a case open with PayPal and their "escalate" date has to be filed by April 15.

When you open a PayPal dispute, it cancels your eBay case, even if it's open and about to conclude with a refund.

eBay has lost control of your refund, as the PayPal dispute has taken over those funds. Now you'll have to start over, and work through the PayPal process. The complication is that PayPal will ask you to return the item, and this time, the seller might provide a different return address, which is their right, but you've already returned to another address, which will not match the new address.
