Context: I bought a $500 item and when I received the item it was destroyed, so I contacted the seller to inform them and ask how I could help, he had me file the claim, so I did just that, but it's been almost a month now and my case is still being reviewed. I called USPS to ask how much longer it would take to review my claim and I was told 30-60 days. I don't have a problem with waiting but if there is a possibility of the claim not being approved and ebays 30 day money back guarantee had already passed then I am essentially screwed. I don't want to have this guy lose his insurance but I also don't want to lose my insurance. What should I do?

File a claim with eBay for damaged item.
If the seller wants you to send item to them then do so if they give you a return shipping label.
If the seller is ok with giving you a refund while you continue the claim process, then accept the refund and reimburse them if the claim is approved and you are paid.
If the claim is disapproved, then the seller will need to decide if they want the item back.

Your claim is with ebay against the seller as a return request - damaged. The seller is the only one that can claim damage for merchandise in transit to a buyer with the carrier. You only have 30 days from delivery to do so - hurry! If unable to open a return request, you will need to open a dispute with paypal/credit card company.

You use the MBG and get your refund, then let then seller deal with the carrier.
Go to your purchase history and click return item and select, the item doesn't match the description as the reason.
The seller will have 3 days to accept the return and pay return shipping or refund without returning.
If they don't, return to the case on day 4 and ask Ebay to step in.
