Your pictures and video don't prove what the buyer received.

we sent black one but the buyer says he received white one.
1. The first picture is what buyer received. The second picture is what we sent to him, could you please let me if that's the same one?
2. We don't stock inventory for this specific product, all the iPad pro we got from our local partner vendor, and we have told this to police.
3. on that day we only sold 1 iPad Pro, you can see it clearly on our sales report
4.on that day we purchase the ipad pro from our vendor, and the receipt we got shows black too
5.security camera records that the one we got on that day is black.
6. our daily sales is $40000, if we simply sent a wrong one, what's the point for me to fight for it? I will just give the buyer return shipping to have him send it back. Why would I risk my store review to fight the buyer????

sales $40000 a day does not mean I make $40000 profit a day. the screen is worth $300, and also if you let this happen to you once, it will continue happening. Whatever it cost, I have to fight for it.

1. You have no Seller Protection with Ebay
2. Ebay Puts Buyers Money back Guaranteed on your listing. Says nothing about Sellers Protection or warnings against buyer Fraud
3. Ebay will tell you they are just the middle man and they don't see the actual product. That means the are the Middle man for the Seller but the Attorney for the Buyers
4. Calling Customer service will not help you unless you are a Buyer or you are a seller who as questions about your account
5. Ebay Hides the Buyers buying record from sellers leaving us open to attack from every scammer on ebay. All you can leave for a buyer is a Positive feedback.
6.Don't leave automatic Feedback for buyers it throws of other sellers who look at them
I would suggest you make a video recording of you opening the item of the package you receive make a youtube video of it you can either get the media involved that will bring attention to the situation you can also use that info that you have to file mail Fraud. If Ebay will not protect you then you will have to protect yourself tell the buyer exactly what eveidence you have and what you will do when the package arrives and he must send the item back exactly as you sent it to him.

I am sorry to tell you this--but Ebay will pay NO ATTENTION to any of your pictures--the other evidence that you have--- because there is no way for you to prove what the buyer actually RECEIVED.
Ebay finds in the favor of the Buyer in 90
I am sorry to tell you this but Ebay will probably pay NO ATTENTION to your pictures or any of your other evidence---because there is no way for you to prove what the Buyer actually RECEIVED.
Because of this Ebay will find in favor iof the buyer 90% of the time.

With all of your documentation, I believe it is worth fighting for. The cameras, sales reports etc are good hard evidence. The sticker is another piece of good evidence. It adds up to swinging in your favor. Have you told the buyer all of this evidence you have and that you will use it to file a police report? That might at least make them sit up and take notice.
Tell them if you get it back you won't file.

This buyer is pulling a Scam on you--that I have seen happen to MANY other sellers in the past! As far as I can tell--Ebay has never brought any of these Scammers to justice.

If you have the serial numbers...Apple numbers, you have an excellent case. Someone's going to use that iPad. It can be traced. You should report it to the police in the area it was purchased. If they are scammers, they'll be caught, someone from the shipper, they'll be caught and fired.

The only thing I have heard of that could possibly get you your money back is by filing a Claim with the Small Business Court. But I think you have to go to the State that the Buyer lives in--in order to get a judge to look at all your evidence.
That does not seem viable to me. Does it to you?

ALRO..
Go to the Police?Ah--if only that would result in a refund. Sure wish it were that easy.

I would check with your local police department about who has juristiction. When I was a victim of ebay fraud, I called the PD where the scammer lived and was told to contact my own PD because I was the victim. Maybe this would apply to you, too.
If you shipped through USPS, would it consitiute mail fraud, which is a felony?

You will need to file with the FBI Online fraud ,Also file with the postal inspectors office also.
