Shorted Multiple Item Order Shipped Separately w/ 1 Tracking Number: SNAD or INR?

What would be the proper dispute in the case of a single listing 3 item order, where seller only ships 2 items?

 

Seller initially claimed that items were shipped on Sun and lost by USPS on Mon (Memorial Day), then when taken to task, admitted out of stock, suggests to refund 1/3 of payment which I agree to, ships the other 2 items in separate packages with the same duplicated USPS label, and then goes radio silent on refund?

 

There is only a single tracking number in the order details. The two items were received. All the back and forth was via eBay messages (there is a paper trail with seller admitting out of stock and suggesting a partial refund for the missing 1/3 of the order)

 

I've mostly ignored previous threads on this topic as they really didn't interest me, and there never seemed to be a clear path to resolution.

 

This is a SNAD (and not INR) situation if it comes to blows?

If the items were paid for together, then open an SNAD case.

SNAD--because you DID receive the items, just not all of them. If the package was sent with tracking, you'd lose an INR out of hand.

 

And I know this because I answered someone incorrectly in another thread and was summarily corrected! LOL!

using the reason: Missing Parts or PiecesOthers will explain where to send your paper trail if you get a return label.

Well, not going be seeing how SNADS or returns work around here now (last SNAD for me was maybe 10? years ago, and really no other issues as a buyer since)

Seller refunded for the out of stock 3rd item this afternoon (after I messaged about it on Friday).

Was contemplating the nuclear option (SNAD, whatever reporting, neg if possible after SNAD), but at this point it's over.

 

Not going to leave any feedback. It's a new seller who has recently managed to get down to 85% under 10 feedback with another out of stock cancellation, and another (undeserved?) neg from a numpty.

I was on the fence about putting the hurt on because:

  • initially lied about OOS with a phoney "USPS lost it" (before it was even mailed) line and then recanted when I asked them to be honest.
  • used a duplicated USPS FCP label on the 2 separate pkgs mailed
  • The OOS itself
  • Dawdling for 6 days before refunding for the OOS item, causing me to contemplate SNAD.
  • the other OOS cancellation and resulting neg

This is a seller that probably shouldn't be selling here, and will probably get chewed up in the eBay machine soon anyway, but I'm not mean enough to be the axeman. Maybe all the factors above are genuine ignorance/noobness, or maybe a calculated plan (destined to fail), but don't meet my criteria for glassing their seller account.
