I have seen many listings that sell digital download or send serial numbers for anti virus software and no shipping. They just send a link or the serial number.
How do they get around paying for shipping when ebay will say there are items waiting to be shipped, purchase postage and then a tracking number is provided?
Will paypal release their money paid if there is no proof of shipping? Will ebay open up a case against the seller?

Here is eBay's digitally delivered policy. Make sure to scroll down and click Read our full policy. This should asnwer your questions.
Also carefully read over the allowed, restricted, and not allowed items.
As you must sell these types of items as Classified Ads, shipping isn't an issue.

Much of this software is not legal to sell ... if it does initially work on your computer, 3 months later you might get a "pay for license or software will stop working" message.
Sellers might have pirated licenses, trial licenses, they are selling licenses from a multi-license package. Little to no cost to the seller.
So, it is zero risk for the seller. If you file "item not received" claim, then they'll happily refund your money.
P.S. If you want anti-virus software, there are plenty of good quality, free options available.

Sellers don’t have to get around paying for shipping; eBay doesn’t make the seller buy an eBay label. eBay doesn’t require sellers to mark items shipped & upload tracking. Those sellers, who as stated, are usually violating eBay policies, usually just mark the items shipped. If the seller is new and subject to the 21 day hold then PayPal releases the funds after 21 days if no tracking is violated. eBay does not open cases against sellers.

Those 'sellers' could be facing criminal prosecution or at least civil litigation if the rights holders of those products chose to push the issue.
