Shipping dammage

I shipped an item that was paletized base on the shippers instructions. 

I purchased insurance. 

The item was severely dammaged.  I refunded the cost of the item,  and the shipping. 

Does eBay help me in any way?  I'm out 2000, and a lathe. It wouldn't pay to ship it back,  they wrecked it.

OP.....I think when you refund the buyer in full you loose your insurance. I did this with a 200 dollar item I sold.

What do you expect eBay to do?  I thought you said that you purchased insurance.  You were required to refund the buyer in full and you should be compensated for the loss by the insurance company.  The item would belong to them if they paid off on your claim so they could do what they want with it.

eBay isn't in anyway responsible.  You need to file an insurance claim and recover your losses from them.  And you had better hurry as there is usually a deadline for filing claims.

No, you shouldn't loose the insurance when you refund the buyer.

On Ebay, you refund the buyer and have them hang on to the item and packing, then file a claim with the carrier.

Don't understand why you think eBay has anything to do with your item being damaged during shipping. That's like expecting the car dealership to get involved when someone crashes into your new car that you just drove off in....

Hello, 

            Even though i insured it with Falvey Insurance,  and sent them documentation that their selected shipper aproves of the way I palletized it. Falver is still insisting,  that I packaged it wrong. 

The shipper is contacting Falvey for me too,  as my lawyer will be too. 

I sold a lathe to an 80 year old man,  I couldn't stang the thought of him losing his money,  so I refunded him the lathe,  and the shipping.

It sounds like this Falvey  Insurance Company is one of those that loves to take your money for premiums but not so when paying off on claims.  It reminds me of a certain auto insurance company that is known for being the one most often having to be sued by its own policy holders.

 

Of course, there is no way for you to have avoided refunding the buyer under the MBG since it is obvious that the item didn't arrive as described.  Unless, of course, your listing described the damage that hadn't already taken place.  If you have that sort of psychic ability I suggest that you give up selling and seek your fortune in gambling. 😉

I would never screw anyone. I sent that man his money back,  plus his shipping,  which I wasnt required to do. 

I also sent him a video,  and still pics of a fully operation lathe,  the pics he sent back were my lathe,  totally dsmmaged. 

Still on the pallet,  the way I strapped it. The damnage was all over the top. Unless falvey decides to own up to the policy,  I'm out an extra 1k for shipping,  besides the 1k for the lathe.. Again,  he's an 80 year old man,  I'm not into screwing people,  I'd rather lose the money than upset him.

Actually, if you review the terms of the MBG I believe that you'll find that you were required to refund the buyer completely regardless of his age and even to pay the return shipping if he had filed a NAD dispute. 

 

But be that as it may, your issue is with the insurance company and/or the shipping company.  Alas!  Litigation may be your only way to get them to pay the claim.  Unfortunately, it is often not economically feasible to take them to court.  Of course, I believe that that is what they're counting on.
