Seller sent an empty box

What more can I do? I purchased a ring . Today , I received the package by USPO. I opened the package (it was fully sealed with no evidence of tampering) , and opened the box, only to find it empty.  This must be a scam. I notified PayPal and they told me to try and contact seller (no reply yet). Paypal says that if seller does not respond, they will refund me. If seller does respond, they directed me to make a police report. I have prurchased jewelry many times on ebay, for over 8 years. I never had an issue like this. I cannot believe that someone would do this. Any advice to me other than what I am doing? Will Paypal really refund me?

You cannot file a case with eBay because you already filed one with PayPal. You have to follow through with the PayPal case.

Open a case on ebay as item not as described. DO NOT open an item not received case. If you open an INR case the seller will input tracking showing you received something (even an empty package) and you will lose.  In your item not as described case state you want to return for refund. Seller has to either pay to get the empty box they sent you back or just refund you.  Other members will be along with more advice. Good luck.

As tina succinctly stated, start with the Not as Described claim on eBay; you can move on to paypal and credit card (if you funded that way) later in the unlikely event that eBay fails you.

 

I would not automatically presume anyone is a crook; it's possible the seller just made a mistake in packing, or it was pilfered by someone else along the way.  Regardless, you are covered, and it will be the seller's problem to figure out where the ring is.

Contact the seller. If their attitude is less than helpful, open a NAD claim. Do not open a not received claim.

Unfortunately the OP has already filed with PayPal and return shipping will be on her, not the seller. The OP cannot file a case with eBay.

Sorry, I did not see anywhere in the OP that she opened a claim in paypal. She stated she spoke with paypal.

It happened to me once, the item was missing, the bag and instruction leaflet was in. I just filed a not as described through e-bay and got a refund later on.

 

Since then I record 'unpackaging' vids for things over $50 in value just in case to protect myself, but I kinda feel it's not necessary anyway

ebay does not accept video evidence but you don’t need it because they will always side with buyer in a not as described case.

Actually I had a case once of a seller asking if I could provide such an evidence of a malfunctioning item. Then he sent me a replacement item... Exactly as **bleep** as the first one thinking (should be a poop emote here). I kinda felt bad for them but still had to do a second NAD

Thank you all for your input! Yes, I made the case through Paypal because I was told that they have good buyer protection .  I did the Paypal claim as "Item not as described" .  Paypal sent communication to seller and there has been no reply. Paypal asked me to make a police report and send a copy to them.  The claim status is currently "Under Review" . So far, from what I have been told, I am in good shape to receive a refund (I really hope so).  I will let everyone know what happens! Thank you all!
