Seller provided tracking number never moved and do not cancel the order

Hi,

 

I purchased a item from this seller and on the next day he provided the tracking number. I found a better deal from another seller and made a return request and asked the original seller to cancel the order since I did not see the item had been really shipped out yet. The seller refused to refund or cancel because they said the item is already shipped. I said it is ok and I will wait and return the item when I received them. Now, it already passed the expected delivery date and the tracking number still was still not updated. The buyer accepted the return and charged 20% restocking fee. I still haven't received the item yet. What should i do?

You shouldn't have opened a return until you have something to return. Did you get refunded yet? It sounds like the seller just took his 20% (which he is entitled to) and never shipped. BTW, sellers are not required to accept a cancellation.

No, I haven't get refund yet. Now eBay is asking me to return the item which i haven't received yet.

You opened a return request so naturally ebay expects you to return the item for a refund. You should be able to close the return request and open an item not received case (which is what you should have done originally as long as the date was past the last estimated delivery date).
