Seller doesnt pickup the return at post office

I purchased a ring from a seller that was defect. It had a big hole that wasnt described or visible in the pictures. I opened a return case and seller gave me a return shipping label and i returned it the same day.

 

It has been delivered by USPS at his PO box and the status says "available for pickup at post office". Because the seller doesnt pickup the item the status doesnt go to delivered and the return status is now stuck at "in transit". There is no button to have ebay step in or escalate the case.

 

I messaged the seller two times to pickup the item and refund me but he doesnt respond. I had a chat session with ebay and they told me the following,

 

"I can see that you added tracking details and have sent this item back to them. It's on you to show the tracking shows it got back to the seller. If the seller doesn't pick it up, the case will be in favor of the seller for you not getting the item back to them."

 

This absolutely blows my mind! So if the seller doesnt pickup the item he gets to keep the money and the case gets ruled in his favor? In what world does this make any sense?

 

I dont know what to do now. It seems like the seller is just stalling time and ebay is facilitating scamming. I did everything right on my end. Its not my fault that he doesnt pick the item up.

 

Should i open a case with paypal?

Hi @febianh88, happy to clarify that delivery attempts or a package being available for pickup are considered to be the same as Delivered for eligibility purposes. You will be able to ask eBay to step in after the seller has been provided with time to refund you. This is typically within 2 business days of delivery, and we would consider the item being available for pickup as the time where the clock starts ticking, so to speak. For example, if the item was available for pickup on the 11th, the seller would have the 12th and 13th to refund, and you would be able to ask eBay to step in on the 14th.

 

I'll keep an eye on this for you and ensure appropriate action is taken if the seller does not refund you as they should. I will also ensure appropriate coaching is provided for any misinformation that was given to you via the chat you referred to. Thank you for bringing this to our attention so we can get this resolved!

Hi @febianh88, just wanted to update that I reviewed the chat transcript and it does look like accurate information was provided regarding when to contact eBay for further protections. Thanks again for giving us a chance to review this situation for any potential improvements!

Update: Just now the seller refunded me only half the amount. He took half off for "Item deductions" saying there is a hole in the item... The hole i described when i returned the item as defect! I immediately asked ebay to step in this is ridiculous. He sells me a defect item and now blames it on me!

And the package is still sitting at his post office. He hasnt picked it up yet. He is obviously scamming me.

Update #2. Ebay closed in my favor. Got full refund. I wish i could edit my feed back and warn others. I dont understand how this seller got a high ranked status and lots of positive feedback. Hes a scammer of the worst kind.

BTW, you can leave a comment on your FB you left for the seller.  But you should know that the seller can also leave a comment if they wish to.

My negative feedback disappeared immediately after the case closed.

Ive been closely checking his negative feedback last couple of weeks. And every day there are angry buyers saying he is selling fake stuff, different items, doesnt ship items, etc etc... But i guess when a case gets solved any negative feedback gets removed.

Now i understand how these sellers keep their high rating. Ebay should fix this. It makes horrible sellers look trustworthy. Im sure some buyers arent even aware theyre receiving cheap fake knockoffs because they think he is a legit honest seller.

It may have been what you said in the FB.  I don't remember, did you share that earlier in the thread.  What exactly did the FB say that you posted?

All the issues ive had with have been with buyers and sellers using PO boxes. Thats why i no longer ship to PO boxes. If somebody gets cheeky and thinks i will ignore what i put in the description and still ship to a box, i cancel the sale and relist. 

 

It's not worth it otherwise. There's a reason UPS doesnt deal with po boxes

Ive been seeing negative FB appearing and disappearing from his page every day.

 

This is an example of what someone posted today, "LIAR!! shipped a piece of **bleep** instead of what I paid for!!!!! **bleep** ALL DAY!!!!"

 

Im sure this one, like all the others will be gone tomorrow or in a couple of days as well. Seller keeps his 99.9% positive FB. If negs wouldnt be removed it wouldnt be that high.

If your seller was permitted to withhold 50% from the refund, after which the buyer can step into eBay for the remaing 50%, does your seller offer free returns? Offering free returns gives you greater control over your business, and eBay will protect you from negative buyer feedback and events outside your control.

As was the outcome for the OP of this thread, when the tracking shows the item is available at the PO box, it is considered delivered.  So if your tracking shows this, there is no risk for you as a seller to be dinged with an INR.

 

As for cancelling orders that have a PO box address.  You do that at your own risk as there is no Ebay rule to justify this as a seller.  So you will get defect on  your selling account if you file the cancellations accurately.  To avoid the ding, you would have to select a reason that is not correct for why you are cancelling the purchase.  Your choice of course.

And if the seller reports that FB, it too will be removed.  There are RULES for both buyers and sellers.  Just because a buyer leaves FB does not mean it is OK.  Buyers have rules just as sellers do.

 

I am only addressing the FB you quoted above.  I can't offer anything on any other FB without knowing exactly what it said.

It should also be noted that there are specific guidelines for withholding up to 50% of the refund for sellers that offer Free Returns.  And you are correct sellers are protected when decreasing the refund as long as it MEETS the guidelines set forth by Ebay.  Sellers Can NOT just deduct because they feel like it.
