I purchased a ring from a seller that was defect. It had a big hole that wasnt described or visible in the pictures. I opened a return case and seller gave me a return shipping label and i returned it the same day.
It has been delivered by USPS at his PO box and the status says "available for pickup at post office". Because the seller doesnt pickup the item the status doesnt go to delivered and the return status is now stuck at "in transit". There is no button to have ebay step in or escalate the case.
I messaged the seller two times to pickup the item and refund me but he doesnt respond. I had a chat session with ebay and they told me the following,
"I can see that you added tracking details and have sent this item back to them. It's on you to show the tracking shows it got back to the seller. If the seller doesn't pick it up, the case will be in favor of the seller for you not getting the item back to them."
This absolutely blows my mind! So if the seller doesnt pickup the item he gets to keep the money and the case gets ruled in his favor? In what world does this make any sense?
I dont know what to do now. It seems like the seller is just stalling time and ebay is facilitating scamming. I did everything right on my end. Its not my fault that he doesnt pick the item up.
Should i open a case with paypal?

Your seller should pick up the package. If they don't, it will still count as delivered for the return you filed. I don't know why the call center gave you information that it wouldn't.
Look at your claim closely. It should actually tell you what date you can escalate it to Ebay. It is on the claim you filed, so take a peek.
Also I will tag someone that should be able to help you just in case there is something more going on here with your inability to escalate the claim. Just to make sure you get this taken care of properly.
I'm very sorry you are having this trouble.

Sounds like you were lied to by an overseas CSR, they can't help you with anything.

If you open a Paypal dispute, the Ebay case will automatically close. Don't close out the Ebay case, escalate it when the option becomes available.
You always want to go in this order for maximum protection: Ebay>Paypal>credit card

Called ebay. If the seller hasnt picked it up tomorrow theyll escalate.
