Seller declined return request on an item that does not fit my vehicle

Hi,

 

I ordered a car part and when I tried to install it, it did not fit. I started a return request and the seller declined the request. The item was supposed to have free 30 day returns and it has not been 30 days. I am not able to contact the seller because it says "The seller is not able to respond to your question." I do not have the option to ask eBay to step in. I cannot find any way to contact anybody, not even on the eBay team. How can I proceed?

What kind of case did you open? A seller can not decline a Not as Described case. But, anyway, how did you pay? If you can't get help from eBay, go to PayPal and open a Not as Described case. If that fails, or you didn't pay with PayPal. open a dispute with your CC company.

Scroll down to the bottom of this page and click on "Resolution Center".  Follow the prompts and open a "Item Not As Described" Case against the seller.  Its not clear as to how you initiated a return request and the seller declined the request.

 

If you paid via Paypal or credit card, open a dispute in Paypal Resolution Center or do a credit card chargeback.

 

If you follow proper procedures you will be refunded.  Also, do not close the case until you have been refunded.

Thank you for your replies. I payed with credit card. I went to Purchase History and hit the Return this item button. For return reason I selected Doesn't fit.

 

Resolution Center says a return request is already open for this item. When I view the return status, it says return is closed. The return details say that the seller declined the return request.

 

However, I just realized that it actually has been over 30 days. I just didn't get around to installing it until yesterday. But it simply does not fit. Is there any way I can get my money back?

I'll tell you how to get your money back!  Just sell the item.  That's the great thing about eBay - you can buy and sell.  You are past the thirty day mark - it isn't right to expect for the seller to take a return.  

 

If you don't want to sell it, you should offer it back to the seller at a deep discount.

There's your problem. If you chose 'doesn't fit', then the seller has declined as that is a remorse reason.

Not to be rude, but are you sure you didn't purchase the wrong part for your make, model, year and trim of vehicle?

Since this seller has free returns they can't decline for remorse returns.  

 

The op has stated it was over 30 days which is what allowed the seller to decline

If the item had 30 day returns, the seller should not have even had an option to decline. When a buyer starts a return for one of my items, it is automatically approved by eBay. Go to the listing and look at the shipping and payments tab. The seller's return policy will be there.

It's over 30 days which is why the seller was able to decline. 

 

Op if it was as described and just didn't fit because you ordered the wrong part there is nothing else you can do except resell it yourself

Yes, the part is exactly for the year make model and trim for my car. The fitment is so off that I could not even mount it. But yes, it has been over 30 days. Can I file a claim that it is not as advertised? Because, I wanted to keep it. But since it doesn't fit, I have no use for it...

The part is correct for my car. It isn't WAY off, but it's off enough. Most of the middle clips clip into place, but the ones on the side do not quite reach. Either way, it is not a minor thing. I am not able to install it at all. Not even with any sort of modification (which should not be in question anyways).

eBay's buyer protection policy is also 30 days from delivery so you can't file with them at all.  If you paid with PayPal you can file with them but you'll be responsible for return costs

Not on ebay.

 

You can do an end run and open a paypal return but you will pay the shipping back and won't get refunded for it.

Seems like a stretch to indicate "not as advertised."  Unless the seller was pulling a fast one by selling you a part for a different make and model, and slapping it in a box for the advertised item, I don't see how he's misrepresenting what he's selling.  If the fitment was so off, wouldn't you have noticed when you received the item?  I get it that you have to actually install it before you know the exact fit with your vehicle, but these doesn't seem like a nefarious act, nor one the seller misrepresenting the item.  

 

How expensive is this item?  This seems like a lot of work to get out a purchase.
