Seller closed return. How can I ask EBay to step in?

Hello,

 

a fraudulent seller on eBay falsely advertised ‘genuine’ Chanel shoes and listed them as a size 6. In our email chain he also said there would be 100% return guarantee if I wasn’t happy. However when they arrived they were a size 5 and NOT real! 

i emailed the seller and requested a refund, as per his earlier msg. He CLOSED the request and has since disappeared! I spent $400 to get them, and I would just like to return them but there is no way to find how to ask Ebay to step in.

 

does anyone have any ideas on this? It’s so utterly frustrating and disappointing that fraudulent sellers can get away with this.

To make sure I understand, you stated that you emailed the seller.  Does that mean you did NOT open an item not as described case?  

Or did you actually open an item not as described case within 30 days of receipt of the shoes?

This information is important in terms of what can be done.

Did you open an ITEM NOT AS DESCRIBED return, or did you by mistake select "doesn't fit"?  Regardless, if the seller is no longer on ebay your will have to open the correct dispute with the payment processor to get your refund.

Did you open a case ITem NOT as described?  Did you then pick "does not fit " instead of saying the seller sent the wrong size.  If you wrote does not fit, it sounds like a remorse return .  Did you use paypal? If yes, go and open a case ITEM NOT AS DESCRIBED.  Write too that they are counterfeit.  Follow the prompts. In paypal, the buyer has to pay the return shipping. No choice since the first case in Ebay was closed by the seller.  So pay the shipping .  MAKE SURE THAT YOU GET THE TRACKING # and put it in the case details.  This is the ONLY proof that you will have that you mailed the shoes and that the seller received them.   Once they arrive, go to Paypal and escalate the case.  You should be refunded.

 

Do NOT open a case with your credit card UNLESS you lose the paypal case.  You can only have one case opened at the same time.

I opened a Return case after the seller didn’t reply to me, and then he CLOSED the Return and rejected it. 

now I don’t have a way of appealing the decision. When I checked on the eBay help centre the article states that any decision taken by the seller is final. 

Might you know how I can appeal this?

I believe when I selected to return the item I put item not as described. The seller is still on eBay! Just ignoring all of my messages and closed the return request as rejected. I can’t seem to open an appeal

Sadly I paid this via Apple Pay. Do you know if I can raise this via them? 

There is no return address listed anywhere so I can’t return the shoes!

Furthermore! I left a negative review after he closed my return and ignored me, and I have just seen that the negative review has been REMOVED! How is that possible?

 

How can eBay side with the perpetrator without understanding the full story? My review stated exactly what I wrote on here!

It is VERY IMPORTANT to know what type of 'return' you did. 

 

If the seller does NOT take returns, and you stated 'wrong size' or something in that manner, then the seller can close the return as it's considered a 'remorse' return, and you cannot open another.

 

If you opened as 'not as described', then the seller cannot close the return. 

 

So again, what reason did you use??

Did you actually open an item not as described case within 30 days of receiving the merchandise? Did you return to the case 4 days later and ask eBay to step in?

Can't think of a way that a seller could close a case without taking some action.

Are we missing some info?

That’s most unfortunate to hear. I believe I wrote wrong size. I didn’t realise there was such thing as seller’s remorse as a legitimate reason to close the case 😭 

 

As the seller wrote in an email to me, that he would offer 100% refund if I wasn’t happy, and I asked if they were authentic shoes, I believed he would honour that when it came to writing telling him that the shoes arrived a size 5 when they were listed as a size 6! I simply cannot wear them. AND they were actually fake designer shoes, not real. 

Double whammy.

So it appears I opened a return case stating they did not fit/wrong size. Apparently seller can close without further action. This is a disgrace and I’m beyond upset

It is up to your to open the correct type of return case, as ebay only goes by what you select.  If you opened the wrong kind by mistake, ebay can't help you.  You still can open the correct one with the payment processor, just be careful you following instructions to get your refund.  Note that now you may have to pay for the return postage instead of the seller.

Curious, since you are in the UK; isn't UK Sizing and USA sizing different?

What country is Seller in??

 

Again, seller can ONLY close the case if the listing states 'no returns' (on a 'remorse')....

 

and I agree, 'wrong size' is misleading and is considered 'remorse' but what one of the options SHOULD be is 'wrong size SENT' - which is what you meant. 

 

But...the way the system is set up, only a 'Not As Described' (which would also be correct if the listing stated size 6 and a size 5 was sent)
