Return a defective item

I purchased a three way trailer hitch on eBay back this past December and I just recently used it for the first time and it's defective. I was forced to purchase a new 3-way trailer hitch that works perfectly from a local parts supply store I showed my three way trailer hitch to a associate at the store and he clearly showed me the defect in the trailer hitch. I sent 2 messages to the seller asking for a full refund but they have not replied. The item was $38.97 ....can I get a refund since I purchased the item last December?

Nope. 30 days for eBay MBG, and 180 days for PayPal protection - you are well outside that, and very unlikely your credit card (if you used a credit card for the purchase) covers a purchase from 8-9 months ago.

Well.....that's a real shame. That means it's okay to sell defective merchandise on eBay. Tooltuff definitely doesn't care enough to even reply to my 2 emails about the item. I appreciate your time at least it was a $38 item not a $380 item.

It's not okay to sell defective merchandise but for pete sake most people try the item out within 6 months............unamused

As aproudparent2010 said "no, that doesn't mean that it's ok to sell defective merchandise on eBay".

What it does mean is that there was a contract, and parameters to that contract, and those parameters gave you the option to get a slam-dunk refund WITHIN THE SPECIFIED TIMEFRAME. Six months via PayPal is more than generous.

You want 8 months. Bob over there wants 14months. Susie thinks it should be for the remainder of her life and that of all her descendents. All think their desires are reasonable, but it isn't what most agree is reasonable or what the terms of the deal were when you purchased, and that line of thinking (what I want/need negates any contract terms) is a path to anarchy.

Hopefully it was a one time issue. I've made 800 purchases and 2000 sales here over the years with maybe half a dozen problems.

Check items IMMEDIATELY. You are way past your time NOW, on ebay and even on Paypal.

Of course it isn't okay to sell defective stuff, but it IS YOUR RESPONSIBILITY to check your purchases when you receive them. I would not even BELIEVE a buyer after 9 months, no wonder the seller isn't responding.
