Return Due to Error in Listing

Hi, All-

 

Sooooo....I bought an item which the seller said was made by a specific manufacturer, using a specific type of material.  I get the item after buying it now and, low and behold, it turns out to be neither.  The seller did not offer a return on the deal, but is this covered by not being sent what was promised in the ad?  He claims it was my fault for not asking for more information, more pics, etc.  My contention is that his listing contained informaiton which turned out to be not true, even if it was done with no mallice.  

 

Any idea who has a stronger case in this...case? And...what if the guy just wouldn't give a refund? Does eBay claw it back, or...??

Go to the Resolution Center and file a claim for SNAD. If the seller does respond within the time frame set by Ebay, then ask Ebay to step in.

 

The sellers No Return policy does not trump Ebays 30 day MBG.

Set of bagpipes.  Bagpipes...nice bagpipes...are usually made of African Blackwood (usually...throughout time, other things have been used,too).  Perhaps one of the most well known firms in the history of bagpipe making is called Henderson; these instruments are much prized, espcially the older ones.  

 

On the other hand, bagpipes made in Pakistan are...well...not so highly prized.  Their workmanship and materials are usually of a lower standard.  As an example, an old set of Hendersons might go for $5k-ish, a set of pipes made in Pakistan, maybe  $100-ish.  They might look OK, but...I suppose it might be like buying a Ferrari that had its engine swapped out with one from a VW Bug.  Kinda...

 

So what did I get?  A bagpipe that was not Henderson and made of a wood other than African Blackwood.  I showed pictures to a respected world authority on makers of bagpipes and he pegged them as being made in Pakistan.  

 

Does this make any sense? 🙂Not ABW...Rosewood??Not ABW...Rosewood??

File a SNAD complaint with eBay and you will get a full refund.

Your the buyer, it doesn't matter.  You will win.  Just file the claim for not being as described.  Whether the seller likes it or not, they will either take the return and refund or Ebay may force them to refund without a return.  Your seller is incorrect.

As unusual an item as a knockoff set of bagpipes might be, it's still not what was advertised. Go ahead and file the SNAD, and let the seller decide if he'll pay for you to return the pipes, let you keep them and refund, or let ebay take it from him if he's stubborn.

As noted above, the listing would be helpful. I am assuming you did not pay 5K for these - as you would be very salty - so I am assuming you paid 100 to 200 dollars for them plus shipping.

 

Did you hope they were henderson or did the listing say that.

Did you hope they were african blackwood or did the listing say that.

 

I ask these specific questions because if the seller didn't infer they were something they weren't and you were gambling that they were something you hoped...well.. kinda stinks to expect the seller to pay for your gamble. 

 

As a reseller, I gamble frequently on buys. Most times I am right, but when I am not, I don't ever put the onus on the seller. Just not ethical.

 

So as the other poster asked above, to be more helpful, we really need to see the listing and how it compares to what you are asking if you want an ethical opinion.

 

If you don't care, and just want your money back, then just file a SNAD as a seller and there will be a good probability that you will  win the case. You may also actually lose the case as on some occasions eBay does take the side of the seller.

OP said bagpipes were advertised as being made of a particular wood by a certain manufacturer. If they were sold as being African blackwood and mfg. by Henderson, OP should certainly file SNAD.

Sellers are supposed to know what they're selling.  If an item is listed as X, but it is actually Y, that is a not as described item. Doesn't matter if the seller did it out of ignorance or intentionally.  A buyer shouldn't have to ask for more information, or ask if the item is what the seller says it it.  Anything in that listing is the responsibility of the seller.

 

You have a not as described item. Open a return request using the reason "not as described."  The seller will be required to provide a prepaid return shipping label. If they cannot, or will not, ask Ebay to step in when the link appears and they will force the refund.
