Recieved wrong item

Hi.

I ordered an xbox on ebay from a seller with good feedback. When it arrived i opened it and it wasn't an xbox but, bizarrely, a lefant robot vacuum cleaner instead (without charger or anything else). Obviously i contacted the seller and they said they definately sent an xbox. They asked for pictures and they said it was definately their packaging. 

Basically we have been going back and forth and they are now just accusing me of lying! 

I have opened an "item not recieved" case with ebay but the seller is refusing to accept the item back as they said they had "no returns" on their listing. However, i noticed that their returns address on ebay was different to the returns address on the shipping label from Hermes but the addresses were not far from each other. 

I now need to wait a few days before contacting ebay again..  I just want the xbox i ordered or my money back. Has anyone has this happen to them before?

You will get your money back. Just order from someone else after.

If the seller is accusing you of lying I would stop communicating with them any further. You need to just wait the 3 business days to ask ebay to step in. Ebay will decide in your favor and 2 things could happen. Ebay will either provide a prepaid shipping label to send the item back and you will be refunded when it shows delivered, or ebay will refund you immediately and you can keep the item you received.

If you opened an item not received case, it was the wrong kind of case to open and probably  will be rejected by eBay.

You DID actually receive something, just not the item you ordered.

eBay usually gives you only one bite of the apple.  Go to Paypal, if that's how you paid and open an ITEM NOT AS DESCRIBED CASE there.

If I recall correctly, if you opened the " item not received" case at ebay you can close the INR case and then can still open an "item not as described" case at ebay.  DON'T open an " item not received case at paypal first or you will have to pay for the return shipping label. You have 30 days from day of delivery to open "item not as described" case at ebay.

You can also call ebay customer service and explain you opened the wrong type of case and need to change it to "item not as described". They will make the change for you.

Obviously a mistake was made. Probably labels were mixed up or something like that. Just open item not as described case in eBay and they will force seller to accept a return.

hi. thanks for the reply. I called ebay (well, they called me actually) and they opened the case for me after i explained what had happened.  The case just says that i requested a return but the seller has refused my return. The seller said " i did not send you a Hoover and i do not accept returns I think we both know you are doing something wrong here i think you should stop now".

Ok, that's good now just wait until you can ask ebay to step in and the seller will soon learn they do accept returns for items not as described.

i agree but the seller has been quite firm. I would of thought they should be concerned where their xbox actually is. i asked them to check with Hermes but they told me "i think you should check with them as everything was correct at my end when it left me". They have been very communicative but they have just not taken any responsibility for the problem. for example they asked me to check with packaging to see if had been opened and to weigh it and they pointed out that they paid for a 4.3kgs package but as i told them the package i recieved was 1.6 kgs. 

However, when i saw that the address on the parcel that was delivered was different to the address for their ebay account (but the addresses were very close to either other in location) they replied "you don't need to worry about the returns address as the return won't be accepted".
