I am having serious trouble with EBay Germany. That is why I’m approaching the mother company via the USA community. Before I go any further: I’m 71 years old and a Brit living in Berlin, Germany.
Now to the problem.
I purchased a refurbished iPhone 8plus from an EBay seller in Ludwigshafen, Germany.
After activation it turned out that the volume down button didn’t work.
I contacted the seller who sent me a return sticker and packed the iPhone in the bubble packing it had come in and used the sellers carton and the filling material it had come with. So the phone was returned in an absolutely identical way it reached me and was totally secured against damaging.
The seller then stated I had returned the phone with a smashed display. It appears obvious that the seller was out to cheat me. I contacted EBay Germany who twice took sides with the seller not with me the cheated buyer. What experience does the community have or EBay Head Office should they read this. What loss for me is involved EURO 560 which is about $630. CAN ANYONE HELP ME??

when you say you contacted Ebay, Germany, do you mean you filed a not as described case? If not, do so, you have thirty days here to file,after delivery..but I dont know about Germanys rules.if you already filed a case with Ebay and they ruled in the sellers favor, you can open a not as described case at Paypal. Or if you paid by cc, try a chargeback on your cc.

My first "knee-jerk" comment is that it is your responsibility to pack the item securely against damage ... the original seller may or may not know what he is doing when he packed, so simply copying his method is not an excuse.
That said, this would appear to be damage in shipping. And, in the US, it is the seller's responsibility to accommodate a return for a Not as Described claim. Since it is the seller's responsibility for shipping, it is ALSO the seller's responsibility to buy insurance, and it should be the seller's responsibility should there be damage in the return shipping.
Finally, in the US, any transaction made by credit card means that you must receive what you purchased. Receiving broken merchandise is a valid claim for a charge-back from the credit card company.
